APDLICANT : TREETOPS UNLIMITED CASE NO: PIP-150 (E) AMENDMENT TO THE LAKE CALAVERA HILLS MASTER PLAN SiTHEREAS, a verified application for certain property wit: A portion of lots D, E, and J of Rancho Agua Hediond according to map thereof No. 823, filed November 16, 1896 has been filed with the City of Carlsbad, and referred to the Planning Commission: and WHEREAS, said verified application constitutes a req' provided by Title 21 of the Carlsbad Municipal Code: and WHEREAS, The Planning Commission did, on the 11th da: Play, 1983, hold a duly noticed public hearing as prescribed b: to consider said request: and PIHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of a11 persor desiring to be heard, said Commission considered all factors relating to the Master Plan: and NGW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the foregoing recitations are true and correct. €3) That based on the evidence presented at the public hearinl the commission APPROVES Pr,P-l50(E) based on the following findings: 27 //// 28 //// -J LL . x e e 1 2 3 4 5 Findings 1) The minor master plan amendment will still provide for a variety of housing types in the Calavera Hills Master Plal area for the reasons outlined in the staff report. 2) The minor master plan amendment is consistent with the Gel Plan designation of the subject property for the reasons outlined in the staff report. "i' The project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Use Planning Manager on April 18, 1983 and approved by th6 Planning Commission on May 11, 1983. 8 ond it ions 9 10 11 12 13 14 15 1 ~) The City is defending two lawsuits which seek to collect reimbursement for the cost of constructing Tamarack Avenuc El Camino Real to the boundaries of the Lake Calavera Hill Master Plan area. The City believes these cases are withc merit and that no reimbursements is owed. However, if reimbursement is ordered, awarded or established, this applicant, as the owner of property benefited by the road, prior to obtaining a final map for the property which is t subject of this action, shall execute an agreement with th City whereby the applicant covenants to pay its proportion share of any reimbursement ordered, awarded, or establishe a result of these or other similar lawsuits. 16 I/ PASSED, APPROVED AND ADOPTED at a regular meeting of the lanning Commission of the City of Carlsbad, California, held o he 11th day of May, 1983, by the following vote, to wit: 18 ill 19 I 20 I AYES : Chairman Schlehuber, Commissioners Marcus, Rombot NOES : None.
