HomeMy WebLinkAbout1983-06-08; Planning Commission; Resolution 2128ll a e /I 1 // PLANNING COMMISSION RESOLUTION NO, 2128 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A 300 UNIT APARTMENT PROJECT ON 15.9 ACRES OF PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF HOSP WAY AND EL CAMINO REAL, APPLICANT: DEVELOPMENT CONSULTANTS CASE NO: PCD-46 6 /I WHEREAS, a verified application for certain propert: 7 /j wit: 8 I1 Lots 1,2,3,4,5,6,11 and 12 of Carlsbad Tract No. 79. according to map no, 10161 filed July 30, 1981, 9 10 11 12 13 14 has been filed with the City of Carlsbad, and referred to thc Planning Commission; and WHEREAS, said verified application constitutes a re( as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 8th day 1 June, 1983, consider said request; and 15 11 WHEREAS, at said hearing, upon hearing and considel 16 17 all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to thl 18 19 20 21 22 23 Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil Commission as follows: (A) That the foregoing recitations are true and correct. Performance of that contract and payment of tl will enable this body to find that public facilitie! be available concurrent with need as required by thc General Plan. 4) The proposed project is compatible with the surrounding land uses since surrounding properties are designated fc residential development on the General Plan. 5) This project will not cause any significant environmenti impacts and a Negative Declaration has been issued by tl Use Planning Manager on May 20, 1983 and approved by thc Planning Commission on June 8, 1983 Conditions: 1) Approval is granted for PCD 46, as shown on Exhibit(s) ' file in the Land Use Planning office. Development shal: substantially as shown unless otherwise noted in these conditions. I* E 11 , dated April 21, 1983 , incorporated by reference a1 I I 2) This project has already been allocated sewer capacity 1 legal settlement 9052 filed August 28, 1979. Building permits for any additional units over and above the settlement will not be issued unless the City Engineer determines that sewer facilities are available at the t. applicatiion for such sewer permits and will continue tc available until time of occupancy. 3) This project is approved upon the express condition tha' applicant shall pay a public facilities fee as required City Council Policy No. 17, dated April 2, 1982, on fill the City Clerk and incorporated herein by reference, an( according to the agreement executed by the applicant fol payment of said fee, a copy of that agreement, dated //// 28 PC RES0 #2128 -2- I/ II e e 1 2 May 25, 1983, is on file with the City Clerk and incorp herein by reference.
