HomeMy WebLinkAbout1983-07-13; Planning Commission; Resolution 2144TI 1 2 3 4 5 6 7 7 e PLANNING COMMISSION RESOLUTION NO. ,2144 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN EIGHT LOT/SEVEN UNIT TENTATIVE TRACT MAP AND PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF TAMARACK AVENUE BETWEEN MARGARET WAY AND ADAMS STREET. APPLICANT: CALIFORNIA BUILDERS CASE. NO: CT 83-8/PUD-52 WHEREAS, a verified application for certain property I 8 wit: 9 A portion of Tract 241 of Thum Lands according to Ma 1681 filed December 9, 1915,. 10 11 12 13 has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a req as provided by Title 21 of the Carlsbad Municipal Code; and 14 15 16 17 18 19 20 21 22 23 24 25 26 27 the Commission APPROVES CT 83-8/PUD-52, based on the 28 WHEREAS, the Planning Commission did, on the 13th da of July, 1983, hold a duly noticed public hearing as prescrib law, to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persc desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Planned Unit Developxl and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannir Conmission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearj following findings and subject to the following conditic //// //// v ,- 0 0 1 Findings: 2 1) The project is consistent with the City's General Plan s the proposed density of 4.19 du/acre is consistent with 3 General Plan density range of 0-4 du/acre. 4 2) The site is physically suitable for the type and density the development since the site is adequate in size and s 5 to accommodate residential development at the density pr /I posed. 6 7 /I 3) The project is consistent with all City public facility icies and ordinances since: 8 9 10 11 12 13 14 15 a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will not be approved unless the City Counc finds that sewer service is available to serve the project. Performance of that contract and payment of tl will enable this body to find that public facilitie: be available concurrent with need as required by thc general plan. 24 25 f) Assurances have been given that adequate sewer for 1 project will be provided by the City of Carlshad. 26 27 //// //// //// 28 PC RES0 NO. 2144 2. i .L. 11 e 0 1 4) The proposed project is consistent with the City's Plannc Development Ordinance and also complies with the Design 2 Guidelines Manual. 3 5) The proposed project is compatible with the surrounding land uses since surrounding properties are designated fo, 4 residential development on the general plan, 5 6) This project will not cause any significant environmenta impacts and a Negative Declaration has been issued by th 6 Use Planning Manager on June 1, 1983 and approved by the 7 Planning Commission on July 13, 1983. 8 9 10 11 12 13 Cond it ions : 1) Approval is granted for CT 83-8/PUD-52, as shown on Exhibit "A" , dated April 23, 1983, incorporated by refer and on file in the Land Use Planning Office.
