HomeMy WebLinkAbout1983-07-13; Planning Commission; Resolution 2149r # 4 i )r a 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 2149 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERKIT TO ALLOW THE SALE AND CONSUMPTION OF ALCOHOLIC BEVERAGES ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF EL CAMINO REAL AND PALOMAR AIRPORT ROAD. APPLICANT: VALLAS CASE NO: CUP-232 I ~ 6 City of Carlsbad and referred to the Planning Commission; and 7 WHEREAS, a verified application has been filed with ' 8 WHEREAS, said verified application constitutes a reql 9 as provided by Title 21 of the Carlsbad Municipal Code; and 10 WHEREAS, pursuant to the provisions of the Municipal 11 property described as: 13 duly noticed public hearing to consider said application on 12 the Planning Commission did, on the 13th day of July , 1983, : 14 15 That portion of Palomar Airport in Lot "G" of Ranchc Hedionda, County of San Diego, according to Map No. 832. ~ 16 WHEREAS, at said hearing, upon hearing and consideri 17 heard, said Commission considered all factors relating to CUE 18 testimony and arguments, if any, of all persons desiring to k /> I\ 19 I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannir 20 (s) That based on the evidence presented at the public heari: 22 (A) That the foregoing recitations are true and correct. 21 Commission of the City of Carlsbad as follows: Commission APPROVES CUP-232, based on the following find 23 and subject to the following conditions: 24 11 Findings 25 26 1) That the requested use is necessary or desirable for th development of the community, is essentially in harmonn 27 the various elements and objectives of the general plan is not detrimental to existing uses or to uses specific permitted in the zone in which the proposed use is to b located for the reasons stated in the staff report. 28 .- I “t m a 2) That the site for the intended use is adequate in size ar 1 shape to accommodate the use for the reasons stated in tk staff report. 2 3) That all of the yards, setbacks, walls, fences, landscap] 4 existing or permitted future uses in the neighborhood wi: provided and maintained. 5 ‘a) That as conditioned, the street system serving the propo! 6 use is adequate to properly handle all traffic generated the proposed use for the reasons stated in the staff rep( 7 Conditions : 8 1) Approval of CUP-232 is granted subject to approval of 9 3 and other features necessary to adjust the requested use SDP 83-6 by the Planning Commission. 2) All conditions of approval of SDP 83-6 are incorporated 10 herein by reference and shall be complied with in their 11 I1 entirety. 12 Alcoholic Beverage Board prior to commencement of this u 13 the 13th day of July, 1983, by the following vote, to wit: l5 Planning Commission of the City of Carlsbad, California, held 1* PASSED, APFROVED AND ADOPTED at a regular meeting of the 3) The applicant shall obtain all necessary approvals from 16 17 AYES : c?lairman ~chlehuhr, Conmissioners Marcus, -tis, NOES: None .
