" I! e 0 -?'I 1 2 3 4 5 6 ~ PLANNING COMMISSION RESOLUTION NO. 2151 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY CARLSBAD, CALIFORNIA, APPROVING AN AMENDMENT TO AN EXISTING CONDITIONAL USE PERMIT TO UPDATE CARLSBAD RACEWAY CONDITIONS ON PROPERTY GENERALLY LOCATED ON NORTH SIDE OF PALOMAR AIRPORT ROAD, TWO MILES EAST 0 CAMINO REAL. APPLICANT: CITY OF CARLSBAD CASE NO: CUP-42 (JI ., 7 WHEREAS, a verified application has been filed with 8 City of Carlsbad and referred to the Planning Commission; and 9 WHEREAS, said verified application constitutes a req 10 as provided by Title 21 of the Carlsbad Municipal Code; and 11 WHEREAS, pursuant to the provisions of the Municipal 12 property described as: 14 duly noticed public hearing to consider said application on 13 the Planning Commission did, on the 13th day of July, 1983, h 15 16 17 18 The southwest half of the northwest quarter and the southwest quarter of tne northwet quarter, all in Se 18, Township 12 South, Range 3 West, San Bernardino Meridian, in San Diego County, WHEREAS, at said hearing, upon hearing and consideri 19 20 testimony and arguments, if any, of all persons desiring to k heard, said Commission considered all factors relating to CUF 1142( J) . 21 22 /I NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin Commission of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hearin 23 24 25 Commission APPROVES CUP-42(J), based on the following fin and subject to the following conditions: 26 27 28 activities are ambiguous and obsolete, and need updating Findings: 1) The Conditional Use Permits regulating Carlsbad Raceway " i G," .. .. I/ * 0 -x " - 1 2 3 4 5 6 2) The Saturday night drag races will be monitored to insur the noise generated does not adversely affect neighborir properties. 3) This use is a temporary use only, and will be reviewed i the near future to determine continued land use compatibility. Conditions : 1) 7 8 9 10 11 12 13 14 This Conditional Use Permit shall be reviewed three year from the date of this ordinance and may be revoked, afte public hearing, if the Planning Commission finds that: E has become incompatible with the developing land uses ir area, b) it has a significant detrimental effect on the public's health and welfare, or c) the conditions impose herein have not been met. At the end of such three year period, there shall be an annual review to establish fur continuance. In the event the permit is revoked, the ow shall have a six month termination period for wind-down the operations. This permit is granted for a maximum pe of five years, after which the owner may re-apply, with guarantee of approval. In addition, this permit may be revoked at any time, after a public hearing, if the Plan Commission makes any of the above three findings. 2) The privileges to operate the raceway are granted solely 15 16 the present owner and shall not be transferable unless approved by the Planning Commission. 3) 17 18 19 20 21 22 23 4) A maximum of five special events may be allowed per year These may include the Motocross International Race, Supe Bike Race, Double-A Fuel Drag Races, or other events specifically approved by the Land Use Planning Manager a Chief of Police. At least 45 days prior to any special event, the track operator shall notify the Land Use Plan Manager and Chief of Police of such request. All night meets shall be subject to a maximum time limit, of 1O:OO P.M. during weekdays and 10:30 P.M. on Fridays ( Saturdays. The program may be extended 30 minutes if racetrack cleanup is necessary for safety reasons. Spec time limitation. 24 5) Noise levels during the races shall not exceed 65 dB SEL (single event level) at any point 2000 feet away from th Raceway property boundary. Within a reasonable time after an event, the premises sh be cleaned of rubbish or waste material to conform with Ordinance No. 5010. The water supply shall be potable water supply as specif by San Diego County Health Department at no expense to t City of Carlsbad. All parking for any event, including special events, shc accomodated on site, in accessible, level areas. No par will be allowed on Palomar Airport Road. The existing 5-foot high chain link fence around the perimeter of the property shall be repaired and maintain the satisfaction of the Land Use Planning Manager prior October 1, 1983. 15 14) The entrance to the Raceway property (ticket booth area) and shall be completed to the satisfaction of the Land U the booths, fence repair and improvement of the entry ro 16 be refurbished and upgraded.
