CHANGE FROM R-1-10,000 TO RD-M ON 6.7 ACRES ON PROPE: GENERALLY LOCATED ON THE SOUTHEAST CORNER OF MARRON AND AVENIDA DE ANITA. APPLICANT: ELDER CASE NO: ZC-283 I WHEREAS, a verified application for certain property 7 it: 8 A portion of Lot IIJ" of the Rancho Agua Hedionda, 9 according to Map thereof No. 823, filed in the Offic the County Recorder, November 16, 1896, and a portio Government Lot No. 3, Section 32, Township 11 South, 11 Carlsbad, County of San Diego, according to official thereof, 12 has been filed with the City of Carlsbad, and referred to the 13 Planning Commission; and 14 WHEREAS, said application constitutes a request as 10 Range 4 West, San Bernardino Meridian, in the City o l5 provided by Title 21 of the Carlsbad Municipal Code; and Ii l6 II WHEREAS, the Planning Commission did on the 27th day ly/July, 1983, hold a duly noticed public hearing as prescribed 18 !to consider said request; and 19 ~ WHEREAS, at said public hearing, upon hearing and 2o 22 desiring to be heard, said Commission considered all factors 21 considering all testimony and arguments, if any, of all perso 23 relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin' 24 Commission as follows: z5 A) That the foregoing recitations are true and correct. 26 B) That based on the evidence presented at the public hearin' 27 following findings and subject to the following condition Commission recommends APPROVAL of ZC-283, based on the 28 I e' 1 0 e 1 2 .Findings: 3 1) That the proposed zone change is consistent with the Ger Plan since the RD-M zone would implement the RMH (Resider Medium High Density, 10-20 du/ac) Land Use designation of General Plan specified for the subject property, as disct 4 in the staff report. 5 9 8 3) That the zoning would not adversely impact surrounding 7 staff report. 6 2) That the subject property is adequate in size and shape 4) That the street system serving the project is adequate 1 accomodate any increase in traffic generated by the zonf 10 as discussed in the staff report. 11 5) This project will not cause any significant environment; impacts and a Conditional Negative Declaration has been 12 by the Land Use Planning Manager on July 6, 1983 and ap] by the Planning Commission on July 27, 1983. accomodate uses permitted in the zone, as discussed in t properties, as discussed in the staff report. l3 lkond i t ions : l4 15 1 ) Approval is granted for 2C-283, as shown on Exhibit "X" July 27, 1983, incorporated by reference and on file in 16 Land Use Planning Office.
