', \rC 0 9 1 PLANNING COMMISSION RESOLUTION NO. 2162 2 3 4 5 6 7 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM RMH (RESIDENTIAL MEDIUM DENSITY, 10-20 DU/AC) TO RVH (RESIDENTIAL VERY HIGH DENSTIY, 30-40 DU/AC) FOR -67 ACRE ON PROPERTY GENERALLY LOCATED AT 3334 HARDING STREET ON THE EAST SIDE OF HARDING STREET BETWEEN PINE AVENUE AND CHESTNUT AVENUE. APPLICANT: GARAPICH/NOGLE & PARTNERS CASE NO.: GPA/LU 83-5 ~~ ~ 8 9 WHEREAS, a verified application for an amendment to General Plan designation for certain property located, as shc lo herein, have been filed with the Planning Commission; and Exhibit "X" , dated August 24, 1983, attached and incorporate( 11 l2 /I WHEREAS, said verified applications constitute a re( 13 14 15 for amendment as provided in Title 21 of the Carlsbad Municil Code; and WHEREAS, the Planning Commission did, on the 24th d, 1611August, 1983, hold a duly noticed public hearing as prescribc l7 /law to consider said request; l8 I WHEREAS, at said public hearing, upon hearing and 19 I/ 1 considering all testimony and arguments, if any, of all persc 20 21 desiring to be heard, said Commission considered all factors relating to the General Plan Amendment. 22 23 24 A) That the above recitations are true and correct. 25 B) That in view of the findings made and considering the 26 27 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil Commission of the City of Carlsbad, as follows: applicable law, the decision of the Planning Commission DENY GPA/LU 83-5, as shown on Exhibit "X", dated August 1983. * ,, "4 1) 9 'I/Findings: 2 3 1) The proposed project site does not have the necessary proximity to the downtown area and commercial core, established as a criteria for application of the RVH 4 designation, as discussed in the staff report. 5 2, 6 7 8 9 3) The proposed project does not ensure the availability oj and moderate income housing units, established as a cril for application of the 2VH designation, as discussed in staff report.
