PLANNING COMMISSION RESOLUTION NO. 2175
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL FOR A
7 LOT/124 UNIT TENTATIVE TRACT MAP AND CONDOMINIUM
ON PROPERTY GENERALLY LOCATED ON THE NORTH AND SOUT
SIDES OF HOSP WAY, WEST OF EL CAMINO REAL.
APPLICANT: DEVELOPMENT CONSULTANTS
CASE NO. : CT 83-15/CP-241
WHEREAS, a verified application for certain propert
wit:
Lots 7, 8, 9, and 10 of Carlsbad Tract No. 79-27
according to Map No. 10161 filed July 30, 1981
has been filed with the City of Carlsbad, and referred to th
Planning Commission; and
WHEREAS, said verified application constitutes a re
as provided by Title 21 'of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did, on the 14th d
September, 1983, hold a duly noticed public hearing as
presecribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all per:
desiring to be heard, said Commission considered all factors
relating to the Tentative Tract Map and Condominium Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni
Commission as follows:
A) That the above recitations are true and correct.
€3) That based on the evidence presented at the public hearj
Commission recommends APPROVAL of CT 83-15/CP-241, baset
the following findings and subject to the following

Findings:
1) The project is consistent with the City's general plan
the proposed density of 9.6 du's/acre is just slightly the density range of 10-20 du's/acre specified for the
indicated on the land use element of the general plan.
2) The site is physically suitable for the type and densit:
the development since the site is adequate in size and to accommodate residential development at the density p posed .
3) The project is consistent with all City public facility
icies and ordinances since:
a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that
final map will not be approved unless the City Coun
finds that sewer service is available to serve the project. In addition, the Planning Cornmission has condition that a note shall be placed on the final
that building permits may not be issued for the pro unless the City Engineer determines that sewer serv available, and building cannot occur within the pro unless sewer service remains available, and the Pla
Commission is satisfied that the requirements of th
public facilities element of the general plan have net insofar as they apply to sewer service for this
project.

July 7, 1983, stating that school facilities will h

c) Park-in-lieu fees are required as a condition of ap
proval, however, credit may be given for any previo
payment of park fees or dedication of land.
d) All necessary public improvements have been provide

e) The applicant has agreed and is required by the inc
of an appropriate condition to pay a public facilit
fee. Performance of that contract and payment of t
will enable this body to find that public facilitie be available concurrent with need as required by th general plan.
f) Assurances have been given that adequate sewer for
project will be provided by the City of Carlsbad.
4) The proposed project is consistent with the City's Plan
Development Ordinance and also complies with the Design
Guidelines Manual.

Conditions
1) Approval is granted for CT 83-15/CP-241, as shown on Ex1
