A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY (
CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF OF A
CHANGE FROM R-3 to RD-H ON PROPERTY GENERALLY LOCATE]
THE EAST SIDE OF HARDING STREET BETWEEN PINE AVENUE ,
CHESTNUT AVENUE,

WHEREAS, a verified application for certain property I 7 wit: I1

Parcel Maps, filed in the off ice of the County Recor

has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
12 WHEREAS, said application constitutes a request as p

WHEREAS, the Planning Commission did on the 12th day 14
by Title 21 of the Carlsbad Municipal Code; and

desiring to be heard, said Commission considered all factors 19

Findings:
1) The zone change will make the zoning consistent with the
density designation of the general plan.
2) The zone change will help provide affordable housing in t
downtown area.
3) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the
Use Planning Manager on July 29, 1983 and approved by the
Planning Commission on August 24, 1983.
4) The applicant has agreed and is required by the inclusion
appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will
this body to find that public facilities will be availabl
concurrent with need as required by the General Plan.
5) The proposed zone change is consistent with all other el€
of the General Plan.
6) Prior to development of any of these parcels a site devel
plan must be approved by the City of Carlsbad to ensure
compatibility with surrounding properties.
Conditions:
1 ) Approval is granted for 2C-282, as shown on Exhibit "X" c
October 12, 1983, incorporated by reference and on file I
Land Use Planning Office.
2) This project is approved upon the express condition that
applicant shall pay a public facilities fee as required k City Council Policy No. 17, dated April 2, 1982, on file the City Clerk and incorporated herein by reference, and
according to the agreement executed by the applicant for of said fee a copy of that agreement dated June 20, 1983, file with the City Clerk and incorporated herein by refel
If said fee is not paid as promised, this application wil
be consistent with the General Plan and approval for this project shall be void.
3) Prior to development of this property, a Site Development must be approved by the City Council.
