APPLICANT: KAP DEVELOPMENT CORPORATION CASE NO: PCD-52 CITY OF CARLSBAD, CALIFORNIA, APPROVING A ~ ~ ~~ WHEREAS, a verified application for certain propert wit: A portion of lot 1 in section 1, township 12 south, 5 west, San Bernardino Meridian, in the City of Car according to Official Plat thereof., has been filed with the City of Carlsbad, and referred to th Planning Commission: and WHEREAS, said verified application constitutes a re as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 26th da October , 1983, consider said request; and WHEREAS, at said hearing, upon hearing and conside all testimony and arguments, if any, of all persons desiring heard, said Commission considered all factors relating to th Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the hearing, the mission APPROVES PCD-52, based on the following findings subject to the following conditions: r . ,I 0 e 1 Findings: /I 2 3 4 5 6 1) The project is consistent with the City's general plan z the proposed density of 29.9 du's/acre is within the der range of 20-30 du's/acre specified for the site as iridic on the land use element of the general plan. 2) The site is physically suitable for the type and densit; the development since the site is adequate in size and i to accommodate residential development at the density p posed. 7 8 3) The project is consistent with all City public facility icies and ordinances since: 9 10 11 12 13 14 15 16 17 ~ l a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will not be approved unless the City Counc finds that sewer service is available to serve the project. Cond it ions : 1 ) Approval is granted for PCD-52, as shown on Exhibit(s) "H", dated October 26, 1983, incorporated by reference file in the Land Use Planning Office. Development shal substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition tha building permits will not be issued for development of subject property unless the City Engineer determines th. sewer facilities are available at the time of applicatic such sewer permits and will continue to be available un' time of occupancy.
