HomeMy WebLinkAbout1983-10-26; Planning Commission; Resolution 2209t * I1 0 * 1 PLANNING COMMISSION RESOLUTION NO. 2209 2 3 4 5 A RESOLUTION OF THE PLANNING COM/ilurISSIOM OF THE CITY CARLSBAD, CALIFORNIA, RECOMMENDING APROVAL OF A ZONE CHANGE FROM R-A-I O AND COUNTY OF SAN DIEGB R-R-2 TO OF CARLSBAD P-C WITH AN F-P OVERLAY ON PROPERTY GENE LOCATED BETWEEN THE EASTERLY EDGE OF AGUA HEDIONDA I AND EL CAMINO REAL. APPLICANT: CAL COMMUNITIES, INC. CASE NO: ZC-29 1 6 /I WHEREAS, a verified application for certain propertl 7 ((wit: a 9 Portion of Lots 'IF" and "I" of Rancho Agua Hedionda according to Map 823 filed November 16, 1896, 10 Planning Commission; and 11 has been filed with the City of Carlsbad, and referred to thc 12 WHEREAS, said application constitutes a request as 13 WHEREAS, the Planning Commission did on the 26th da; 14 provided by Title 21 of the Carlsbad Municipal Code; and 15 October, 1983, hold a duly noticed public hearing as prescril 16 law to consider said request; and 17 relating to the Zone Change; and 20 desiring to be heard, said Commission considered all factors 19 considering all testimony and arguments, if any, of all persc 18 WHEREAS, at said public hearing, upon hearing and 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni 22 1) The project is consitent with the City's General Plan s 27 Findings : 26 following findings and subject to the following conditio 25 B) That based on the evidence presented at the public heari 24 A) That the foregoing recitations are true and correct. 23 Commission as follows: the proposed residential densities are within the densi 28 ranges specified for the properties as indicated on the Use Element of the General Plan. The project is consistent with all City public facility icies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will not be approved unless the City Counc finds that sewer service is available to serve the project. In addition, the Planning Commission has a condition that a note shall be placed on the final m that building permits may not be issued for the proj unless the City Engineer determines that sewer servi available, and building cannot occur within the proj unless sewer service remains available, and the Plan Commission is satisfied that the requirements of the public facilities element of the general plan have t met insofar as they apply to sewer service for this project. b) The Carlsbad School District has written a letter, d September 12, 1983, stating that school facilities F; available to this project. Land Use Impact: The proposed development of the site coulc a potential adverse impact on sensitive biological habitats. C. D. 19 I 20 21 22 23 24 26 25 F. 27 28 PC RES0 Biological Resources Impact: Development of the subject property for residential use could adversely effect sensitive we habitats. Mitigation: The Master Plan for the development of area will provide restrictions on development adjac to the wetlands. Portions of the remaining wetland be enhanced to the satisfaction of the Department c and Game. A six foot high chain link fence will be constructed around the edge of the wetlands area. Agriculture Impact: Annexation and future development of the s without some preservation of the existing agricultu the hill would be a significant impact based on Cou and State agency policies. Mitigation: The City of Carlsbad has no exclusive1 agricultural general plan designation, Some of the existing agricultural uses in the floodplain will k retained. Traffic Impact: The proposed project will increase the am0 traffic in the area of the project. Mitigation: There should be no adverse traffic imp if all roads serving the project and the surroundin neighborhood are constructed to their planned width Hydrology/Water Quality Impact: There will be no direct impacts on hydrolog water quality from the proposed project, however, in or future impacts could occur with development. Mitigation: The City has placed the Floodplain Over zone on the portions of the site within the 100 year floodplain. When development plans are approved spe grading requirements may be necessary to protect thi from urban runoff and sedimentation. Air Quality Impact: The project, at developent would result in incremental impact to regional air quality. Mitigation: Various mitigation measures such as rid and transit programs should be included in the maste plan. Additionally, the need to provide diverse hou types in the City of Carlsbad overrides this impact. Cultural Resources Impact: The proposed project will not have a direc impact on cultural resources, however, four potenti significant sites were found on the property and co impacted at time of development. Mitigation: Testing, excavation, and preservation four significant sites as identified by an Environm Impact Report will be required prior to issuance of grading permit. H. Visual Quality/Aesthetics Impact: No direct impacts would be created by the project. Future development under the proposed designations could have a visual impact on the nort south shores of Agua Hedionda Lagoon. Mitigation: Mitigation will have to occur at the m plan and at specific project levels. Mitigation wi include design of projects in accordance with the A Hedionda Local Coastal Plan, preservation of specif areas, clustering development and special landscapi requirements. I. Community Services Impact: No direct impacts will be created by this project. Future development of the site could resu potential impacts relating to water conservation, SI waste disposal, energy conservation, police and fir' protection and hospital facilities. Mitigation: Some of these potential impacts can be mitigated by the payment of public facilities fees. Other potential impacts can be mitigated by the pay of public facilities fees. Condition 1) This zone change is granted subject to the unconditiona certification of an amendment to the Agua Hedionda Loca Coastal Plan by the California Coastal Commission. If I certification is not granted, the portions of this zone change located within the Agua Hedionda Local Coastal P: shall remain under the existing zone change.
