HomeMy WebLinkAbout1983-11-09; Planning Commission; Resolution 2187t- h 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 6 0 PLANNING COMMISSION RESOLUTION NO. 2187 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT TO PERMIT A CHURCH IN THE R-1-7500 ZONE ON PROPERTY GENERALLY LOCATED ON FUTURE McCAULEY LANE, WEST OF THE NORTHWEST INTERSECTION OF MONROE STREET AND ELM AVENUE. APPLICANT: JEROVAH'S WITNESSES CASE NO: CUP-236 WHEREAS, a verified application has been filed with City of Carlsbad and referred to the Planning Commission; an WHEREAS, said verified application constitutes a re as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipa Code, the Planning Commission did, on the 9th day of Novembe 1983, hold a duly noticed public hearing to consider said application on property described as: Parcel A of Parcel Map 1210 filed January 2, 1973 a portion of Lots 30 and 31 according to Map 565 file September 22, 1888. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all pers desiring to be heard, said Commission considered all factors relating to CUP-236. NOW, THEREFORE, BE IT HEREBY FSSOLVED by the Planni Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hearj the Commission DENIES CUP-236, based on the following findings and subject to the following conditions: Findings : 1) The proposed project will be detrimental to future resic along McCauley Lane which would be permitted in the R-l- zone as discussed in the staff report. “- t 6 0 1 2 3 4 PASSED, APPROVED AND ADOPTED at a regular meeting o 5 Planning Commission of the City of Carlsbad, California, he1 the 9th day of November, 1983, by the following vote, to wit 2) The proposed street system serving the proposed use is n adequate to properly handle traffic generated by the pro use because it is a cul-de-sac street serving a single f neighborhood and the proposed church would create traffi conflicts as discussed in the staff report. 6 7 8 AYES : Chairman Schlehuber, Ccaranissioners Rombotis, -?brcus, NOES: Cnmksioner Friestedt and Rawlins.
