PLANNING COMMISSION RESOLUTION NO. 2219
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO PERMIT
FOOT DRIVEWAY TO ALLOW THE CREATION OF PANHANDLE LO?
1448 FOREST AVENUE.
APPLICANT: DECKELMAN
CASE NO: V-350
WHEREAS, a verified application for certain property
wit:
portion 1 of Cedar Hill Addition, Map 532 City of
Carlsbad, filed in the County of San Diego,
has been filed with the City of Carlsbad, and referred to thc
Planning Commission; and
WHEREAS, said verified application constitutes a re(
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, tne Planning Commission did on the 9th day
November , 1983, hold a duly noticed public hearing as presc
by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and a
testimony and arguments, if any, of all persons desiring to
heard, said Commission considered all factors relating to th
Variance; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni
Commission as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public heari
Commission APPROVES V-350, based on the following findir
subject to the following conditions:
Findings:
1) There are exceptional or extraordinary circumstances
applicable to the property that do not apply generally t
other property in the same vicinity in that the existinc
was built at the turn of the Century and may have histor
value.

2) The granting of this variance is necessary for the preser'

I) Approval is granted for V-350 €or the location, as shown
Exhibit "A" dated November 9, 1983, incorporated by refer
and on file in the Planning Department.

This project is approved upon the express condition that
applicant shall pay a public facilities fee as required 33
Council Policy No. 17, dated April 2, 1982, on file with
City Clerk and incorporated herein by reference, and acco
to the agreement executed by the applicant for payment of
fee. A copy of that agreement dated September 6, 1983 is
file with the City Clerk and incorporated herein by refer
If said fee is not paid as promised, this application wil
be consistent with the General Plan and approval for this
project shall be void.
