HomeMy WebLinkAbout1983-12-14; Planning Commission; Resolution 2214w. 7 // 0 0 1 PLANNING COMMISSION RESOLUTION NO. 2214 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY 1 CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A MAS' PLAN AMENDMENT FOR THE CALAVERA HILLS MASTER PLAN ON PROPERTY GENERALLY LOCATED IN THE CALAVERA HILLS MAS' PLAN AREA. APPLICANT: CALAVERA HILLS CO. CASE NO.: MP-l5O(F) 6 ll WHEREAS, a verified application for certain property 7 /I wit : a 9 Portions of Lots D, E, and J of Rancho Aqua Hedionda according to Map 823 filed November 16, 1896 10 11 12 13 has been filed with the City of Carlsbad, and referred to the Planning Commission: and WHEREAS, said verified application constitutes a req as provided by Title 21 of the Carlsbad Municipal Code; and 14 /I WHEREAS, the Planning Commission did, on the 9th and 15 li days of November and the 14th day of December, 1983, hold a d 16 17 18 19 20 21 22 noticed public hearings as prescribed by law, to consider sai request; and WHEREAS, at said public hearings, upon hearing and considering all testimony and arguments, if any, of all persc desiring to be heard, said Commission considered all factors relating to the Master Plan: and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin 23 24 Commission as follows: A) That the foregoing recitations are true and correct. 25 1 B) That based on the evidence presented at the public heari the Commission recommends APPROVAL of MP-l50(F) based or 26 following findings and subject to the following conditic 27 28 Findings: 1) The proposed master plan amendment is appropriate for tk for the reasons stated in the staff report. //// I, ll 0 0 1 2) The proposed master plan amendment will not adversely iq existing or future development in the area for the reaso: 2 stated in the staff report. 3 3) The applicant has agreed and is required by the inclusio appropriate condition to pay a public facilities fee. 5 this body to find that public facilities will be availab concurrent with need as required by the general plan. 4 Performance of that contract and payment of the fee will 6 7 €3 9 10 11 4) 5) The residential and open space portions of the community constitute an environment of sustained desirability and stability; and it will be in harmony with or provide compatible variety to the character of the surrounding a and the sites proposed for public facilities, such as sc playgrounds and parks, are adequate to serve the anticip population and appear acceptable to the public authoriti having jurisdiction thereof.
