APPLICANT: PINE STREET APARTMENT COMPLEX CASE NO.: V-352 WHEREAS, a verified application for certain propert wit: The Northeasterly 159 feet of Tract 99 of Carlsbad in the City of Carlsbad, County of San Diego, Statt California, according to Map thereof No. 1661, filc the Office of the County Recorder of San Diego, Mal 1915. has been filed with the City of Carlsbad, and referred to tl Planning Commission; and WHEREAS, said verifed application constitutes a re provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 25th January, 1984, hold a duly noticed public hearing as prescr law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all pel desiring to be heard, said Commission considered all facto] relating to V-352. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plan: Commission of the City of Carlsbad as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public he Commission recommends APPROVAL of V-352, based on the findings and subject to the following conditions; Findings: 1) Exceptional or extraordinary circumstances exist due existing adjacent railroad. General Plan. 10 11 2) 12 13 14 In the event that the railroad right-of-way is utilizei parking purposes the developer shall install a 6 foot c link fence the length of the east side of the railroad of-way parking area.
