CARLSBAD, CALIFORNIA, APPROVING A PLANNING COMMISSI DETERMINATION TO INCREASE THE ALLOWABLE DENSITY FOF APARTMENT PROJECT FROM 10 DU'S/ACRE TO 19.29 DU'S/J PROPERTY GENERALLY LOCATED AT 475 CHESTNUT STREET. APPLICANT: BEN STABILE CASE NO.: PCD-54 WHEREAS, a verified application for certain propert wit: A portion of Block D, Tract 107, of the amended may: Town of Carlsbad, Map 775, recorded March 3, 1891, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a re as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 22nd d February, 1984, consider said request; and WHEREAS, at said hearing, upon hearing and consider testimony and arguments, if any, of all persons desiring to heard, said Commission considered all factors relating to th Planning Commission Determination; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hear the Commission APPROVES PCD-54, based on the following findings and subject to the following conditions: Findings: 1 ) The proposed project complies with all requirements of . Carlsbad Zoning Ordinance as discussed in the staff rep( 2) The design of the proposed project justifies the densit! requested as discussed in the staff report. This condition shall in no way bind t to vacate this area. No building permits shall be issc until the abandonment procedure is complete. If the Cj chooses not to vacate said portion of Chestnut Avenue, approval will no longer be valid. Prior to occupancy, foot vacation shall be entirely landscaped. 14) The developer shall obtain a grading permit prior to tf commencement of any clearing or grading of the site. 15) No grading shall occur outside the limits of the subdir unless .a letter of permission is obtained from the own( the affected properties. ' 19) The developer shall coordinate his street improvement p and construction with those of the property to the west project site. 20) The design of all private streets and drainage systems approved by the City Engineer prior to approval of the map. The structural section of all private streets sha: conform to City of Carlsbad Standards based on R-value All private streets and drainage systems shall be inspel the city, and the standard improvement plan check and inspection fees shall be paid prior to approval of the ~ map. 21) All private driveways shall be kept clear of parked veh all times, and shall have posted "NO Parking/Fire Lane ' Zone" pursuant to Section 17.04.040, Carlsbad Municipal I Fire Department 22) An all weather access road shall be maintained throughol construction. 23) All required fire hydrants, water mains and appurtenancc be operational prior to combustible building materials 1 located on the project site.
