I/ PLANNING COMMISSION RESOLUTION NO. 2259 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT FOR 21 UNITS ON 1.01 ACRES OF PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF CHINQUAPIN AVENUE BETWEEN GARFIELD STREET AND THE AT&SF RAILROAD. APPLICANT: VINEDALE CASE NO: CT 84-3/CP-271 7 WHEREAS, a verified application for certain propert: 8 wit: 9 10 A portion of lots 1 and 2 in Block "S" of Palisades 2, according to Map thereof No. 1803, filed in the ( of the County Recorder, August 25, 1924, 11 relating to the Tentative Tract Map and Condominium Permit; 21 desiring to be heard, said Commission considered all factors 20 considering all testimony and arguments, if any, of all pers 19 WHEREAS, at said public hearing, upon hearing and 18 law, to consider said request; and bi 17 March, 1984, hold a duly noticed public hearing as prescribe1 16 WHEREAS, the Planning Commission did, on the 14th d 15 as provided by Title 21 of the Carlsbad Municipal Code; and 14 WHEREAS, said verified application constitutes a re1 13 Planning Commission; and 12 has been filed with the City of Carlsbad, and referred to thl 22 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni 23 (A) That the foregoing recitations are true and correct. 24 Commission as follows: 25 26 27 28 (B) That based on the evidence presented at the public hear the Commission hereby APPROVES CT-84-3/CP-271, based on the following findings and subject to the following conditions: //// //// I J I II e * 1 /I Findings: 2 3 4 5 6 1) The project is consistent with the City's general plan : the proposed density of 20.79 du's/acre is within the dc range of 20-30 du's/acre specified for the site as indic on the land use element of the general plan. 2) The site is physically suitable for the type and densit; the development since the site is adequate in size and to accommodate residential development at the density p posed . 7 8 3) The project is consistent with all City public facility icies and ordinances since: a) The Planning Commission has, by inclusion of an 9 appropriate condition to this project, insured that final map will not be approved unless the City Coun' 10 finds that sewer service is available to serve the project. In addition, the Planning Commission has I1 condition that a note shall be placed on the final that building permits may not be issued for the pro 12 unless the City Engineer determines that sewer serv available, and building cannot occur within the pro 13 unless sewer service remains available, and the Pla Commission is satisfied that the requirements of th' 14 public facilities element of the general plan have met insofar as they apply to sewer service for this 15 project. 16 17 b) The Carlsbad District has written a letter, dated J 19, 1984, stating that school facilities will be av ~ to this project. CC&R's shall be submitted to and approved by the Land U Planning Manager prior to final map approval. 10) The applicant shall prepare a detailed landscape and ir tion plan which shall be submitted to and approved by t Use Planning Manager prior to the issuance of building permits. 11 ) All parking lot trees shall be a minimum of 15 gallons size. 12) A master plan of the existing on site trees shall be pra to the Land Use Planning Manager as part of the final g plan to determine which trees shall be required prior t' issuance of a grading permit or a building permit, whic occurs first. 13) All landscaped areas shall be maintained in a healthy a thriving condition, free from weeds, trash, and debris. 14) Any signs proposed for this development shall be design conformance with the City's Sign Ordinance and shall re' review and approval of the Land Use Planning Manager pr installation of such signs. 15) Trash receptacle areas shall be enclosed by a six-foot masonry wall with gates pursuant to City standards. The developer shall submit to and obtain th approval of the City Engineer of a plan to achieve this to issuance of any permits for this project. Fire Conditions 30) Additional public and/or on site fire hydrants shall be quired if deemed necessary by the Fire Marshall. 31 ) The applicant shall submit two (2) copies of a site pla showing locations of existing and proposed fire hydrant on site roads and drives subject to the approval of the Marshall. 32) An all weather access road shall be maintained through0 construction. 11 33) All required fire hydrants, water mains and appurtenanc shall be operational prior to combustible building mate 12 being located on the project site. 13 34) All fire alarm systems, fire hydrants, extinguishing sy project shall be submitted to the Fire Department for a 14 automatic sprinklers, and other systems pertinent to th prior to construction. 15 16 PASSED, APPROVED AND ADOPTED at a regular meeting o 17 Planning Commission of the City of Carlsbad, California, hell 18 the 14th day of March, 1984 , by the following vote, to wit: 19 I 2o I AYES : Chairman Rombotis, Commissioners Schlehube NOES: None.
