I1 PLANNING COMMISSION RESOLUTION NO. 2273 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 I 23 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM R-1-15,000 TO C-T-Q, COMMERCIAL TOURIST ZONE FOR 2.02 ACRES OF PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF ADAMS STREET, WEST OF HOOVER STREET, APPLICANT: OAKLEY PARKER CASE NO: ZC-303 WHEREAS, a verified application for certain propel wit: Lots 1 and 2, Block A, Bella Vista and the wester: feet of Lot A, according to Map thereof No. 2152, in the Off ice of the County Recorder, has been filed with the City of Carlsbad, and referred to ' Planning Commission; and WHEREAS, said application constitutes a request a! provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 11th ( April, 1984, hold a duly noticed public hearing as prescril law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all pe' desiring to be heard, said Commission considered all facto relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plan Commission as follows: A) That the foregoing recitations are true and correct. 24 B) That based on the evidence presented at the public hea 25 Commission recommends APPROVAL of ZC-303, based on the following findings and subject to the following condit 26 27 28 Agua Hedionda Land Use Plan, as discussed in the staff Findings: 1) That the proposed zone is consistent with the General I \ 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I 0 a 2) That the proposed zone is appropriate for the site, as discussed in the staff report. 3) That the provisions of the Agua Hedionda Land Use Plan provide for standards and review to ensure compatibilit the uses permitted in the proposed zone and surrounding existing and future land uses, as discussed in the staf report. 4) The applicant has agreed and is required by the inclusi an appropriate condition to pay a public facilities fee Performance of that contract and payment of the fee wil enable this body to find that public facilities will be available concurrent with need as required by the Gener Plan. 5) The Land Use Planning Manager has determined that the environmental impacts of this project have been already considered in conjunction with another project and prev certified environmental documents and, therefore, issue Notice of Prior Environmental Compliance on March 28, 1 Conditions: 1 ) Approval is granted for ZC-303, as shown on Exhibit "X April 11, 1984, incorporated by reference and on file Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition th building permits will not be issued for development of subject property unless the City Engineer determines t sewer facilities are available at the time of applicat such sewer permits and will continue to be available u time of occupancy. This note shall be placed on the f map. 3) This project is approved upon the express condition th applicant shall pay a public facilities fee as require City Council Policy No, 17, dated April 2, 1982, on fi the City Clerk and incorporated herein by reference, a according to the agreement executed by the applicant f payment of said fee, a copy of that agreement, dated F 10, 1984, is on file with the City Clerk and incorpora herein by reference.
