L 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 I r * * PLANNING COMMISSION RESOLUTION NO. 2265 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A 48 UNIT TENTATIVE TRACT MAP AND CONDOMINIUM PERMIT ON PROPERTY GENERALLY LOCATED ON THE NORTHWEST CORNER OF ALGA ROAD AND EL FUERTE STREET APPLICANT: LA COSTA POINTE CASE NO: CT 84-2/CP-270 WHEREAS, a verified application for certain propert wit: Lots 413-416 of La Costa Meadows, Unit 3 per Map 70 filed October 6, 1971 has been filed with the City of Carlsbad, and referred to th Planning Commission; and WHEREAS, said verified application constitutes a re< as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 28th di March, 1984 and on the 11th day of April, 1984, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persc desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannir! Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearin the Commission hereby DENIES CT 84-2/CP-270, based on the following findings: Findings : 1) The project's density of 16.9 dwelling units per acre, be towards the high end of the density range of 10-20 dwelli: units per acre designated for this site, cannot be ~ustlf for the following reasons: i. *. q 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 a) The project's design is unimaginative and is not wc integrated with the site constraints; and amenities over and above the minimum standards of Planned Development Ordinance. b) The project does not provide significant on-site c) The project as designed and at the density proposec not compatible with the surrounding residential development in the vicinity. 2) The units in the southern portion of the project are located 10' from the 10' high crib wall and a 1 1/2: 1 slope. As such, these units are impeded from the free of light and air. PASSED, APPROVED AND ADOPTED at a regular meeting ( Planning Commission of the City of Carlsbad, California, he: the 9th day of May, 1984, by the following vote, to wit: AYES : Chairman Rombotis, Commissioners Rawlins, Schlehuber, Marcus , Farrow and Smith .
