APPLICANT: CAMINO HILLS CASE NO: CT 83-25/MHP 83-2 WHEREAS, a verified application for certain propert wit: All that portion of Lot "F" of Rancho Agua Hedionda the County of San Diego, State of California, accor to map thereof No. 823, filed in the office of the Recorder of said County has been filed with the City of Carlsbad, and referred to th Planning Commission; and WHEREAS, said verified application constitutes a re as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did, on the 9th di May, 1984, hold a duly noticed public hearing as prescribed to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all pers desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public heal the Commission recommends APPROVAL of CT 83-25/MHP 83-: on the following findings and subject to the following conditions: I /I// //// > 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Findinas: 2 1) The project is consistent with the City's general plan the proposed density of 3.79 du's/acre is within the de range of 0-4 du's/acre specified for the site as indicc the land use element of the general plan. 2) The site is physically suitable for the type and densit the development at the density proposed. 3) The project is consistent with all City public facilitl icies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will not be approved unless the City Cour finds that sewer service is available to serve the project. In addition, the Planning Commission has condition that a note shall be placed on the final that building permits may not be issued for the prc unless the City Engineer determines that sewer sen available, and building cannot occur within the prc unless sewer service remains available, and the P1; Commission is satisfied that the requirements of tl public facilities element of the general plan have met insofar as they apply to sewer service for thiz project . b) The Carlsbad School District has written a letter, dated September 2, 1983, stating that schoc facilities will be available to this project. c) Park-in-lieu fees are required as a condition of ay proval . d) All necessary public improvements have been providt will be required as conditions of approval. e) The applicant has agreed and is required by the inc of an appropriate condition to pay a public facilil fee. This area may be susceptible to failure. Mitigation: The project has been conditioned so as reduce the likelihood of movement in t area. Such measures will include buttressing and other common engineeri techniques. B) Biological Resources Impact: Two rare and endangered species exist onsite. Mitigation: The San Diego Thornmint species is loc in a natural open space area onsite. Brodiaea Filifolia species will remain partially undisturbed and partially transplanted onto an onsite fenced pre area . C) Land Use Impacts : Approximately 3 acres of the project 1 within the PI land use designation. Mitigation: The project has been redesigned to avo this area. Impacts: The project does not incorporate desig features which would justify the reque dens i ty . Mitigation: The project has been redesigned to inc these features . l9 I! If said fee is not paid as promised, thj application will not be consistent with the General Plz approval for this project 'shall be void. The applicant shall pay park-in-lieu fees to the City, to the approval of the final map as required by Chapter of the Carlsbad Municipal Code. Approval of this request shall not excuse compliance wj sections of the Zoning Ordinance and all other applicak ordinances in effect at time of building permit issuanc according to the agreement executed by the applicant €( 14 15 16 17 7) This approval shall become null and void if building PC are not issued for this project within one year from tl of project approval. 8) Water shall be provided to this project pursuant to thr ' Service Agreement between the City of Carlsbad and the Real Water District, dated May 25, 1983. 18 19 Land use Planning Conditions: 9) The applicant shall prepare a reproducible mylar of the site plan shall be submitted to and approved by the Lar 20 Planning Manager prior to the issuance of building per5 21 site plan incorporating the conditions contained hereir 22 23 24 25 26 27 10) The applicant shall establish a homeowner's associatior corresponding covenants, conditions and restrictions. CC&R's shall be submitted to and approved by the Land I Planning Manager prior to final map approval. Said map shall show all lots and streets w and adjacent to the project. 13) All landscaped areas shall be maintained in a healthy i thriving condition, free from weeds, trash, and debris, 14) Any signs proposed for this development shall be desigr conformance with the City's Sign Ordinance and shall rc review and approval of the Land Use Planning Manager PI installation of such signs. 15) Trash receptacle areas shall be enclosed by a six-foot masonry wall with gates pursuant to City standards. The developer shall construct desiltation/detention bas a type and size and at locations as approved by the Cit Engineer. The developer shall enter into a desiltatior maintenance agreement and submit a maintenance bond satisfactory to the City Engineer prior to the approval final map for this project. Each desiltation basin sh: serviced by an all weather access/maintenance road. T1 provisions of this agreement shall apply to any off-sit borrow sites which may be utilized in the construction project as required by the City Engineer. The owner of the subject property shall execute a hold harmless agreement regarding drainage across the adjacc property prior to approval of the final map. All land and/or easements required by this project sha! granted to the City, without cost to the City, free ani of all liens and encumbrances. Improvements including, but not limited to, the follow: items shall be installed by the developer and approved City Engineer prior to filing the final map. Alternatc installation of said improvements shall be guaranteed 1 security agreement obtained by the developer in an am01 of a type required by the Carlsbad Municipal Code.
