HomeMy WebLinkAbout1984-05-23; Planning Commission; Resolution 2297- -i 1 2 3 4 5 6 7 a e e PLANNING COMMISSION RESOLUTION NO. 2297 A RESOLUTION OF THE PLANNING COMMISSION OF THE AMENDMENT TO PLANNING COMMISSION RESOLUTION NO. 2229 AND CITY COUNCIL RESOLUTION NO. 7472 PURSUANT TO SECTION 21.45.160(2) OF THE CARLSBAD MUNICIPAL CODE TO MAKE A MINOR REVISION TO A PREVIOUSLY APPROVED PLANNED UNIT CITY OF CARLSBAD, CALIFORNIA, APPROVING AN DEVELOPMENT ON PROPERTY GENERALLY LOCATED WEST OF NEBLINA DRIVE AND SOUTH OF TAMARACK AVENUE . APPLICANT: TELESCOPE POINT CASE NO: PUD-39 l B 1 ~. , WHEREAS, a verified application for certain propert1 9 10 11 Map No. 823 filed November 16, 1896,. wit: A portion of Lot I of Rancho Agua Hedionda accordin< 12 13 has been filed with the City of Carlsbad, and referred to thc to consider said request; and 18 Yay, 1984, hold a duly noticed public hearing as prescribed t 17 WHEREAS, the Planning Commission did, on the 23rd d: 16 as provided by Title 21 of the Carlsbad Municipal Code; and 15 WHEREAS, said verified application constitutes a rec 14 Planning Commission; and 19 WHEREAS, at said public hearing, upon hearing and 20 23 relating to the Tentative Tract Map and Planned Unit Developr 22 desiring to be heard, said Commission considered all factors 21 considering all testimony and arguments, if any, of all persc following findings and subject to the following conditic 28 (B) That based on the evidence presented at the public hear: 27 (A) That the foregoing recitations are true and correct. 26 Commission as follows: 25 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil 24 and the Commission hereby APPROVES PUD-39(B), based on the I t > 0 0 1 \I // Findings: 2 1) The proposed amendment to Planning Commission Resolutic and substantially in conformance with the previously a1 3 project . 4 2229 and City Council Resolution No. 7472 is minor in I 5 1) City Council Resolution No. 7472 and Planning Commissic 8 Conditions: 7 Environmental Compliance was issued May 8, 1984. 6 2) This project has already been considered in conjunctio~ Resolution No. 2229 are amended by the addition of the a previously certified document and a Notice of Prior 9 following conditions: 10 11 a) Approval shall be granted as shown on Exhibits "A" "B", dated May 23, 1984 and incorporated herein by reference. 12 13 14 15 16 17 18 19 20 21 22 b) Prior to issuance of a building permit for the ten1 court the lighting plan for this facility shall be reviewed by the Director of Planning and Building 1 determine that no light spills over onto the exist: nearby residences. c) The hours of use of the proposed tennis court shall limited to 7:OO a.m. to 1O:OO p.m. This shall be c stated in the CC&R's for Telescope Point and shall posted on the courts. If legitimate complaints occ from surrounding properties the Land Use Planning E may adjust the hours of use to 7:OO A.M. to 9:00 P, d) The area between the tennis court and the property east shall be heavily landscaped with trees.
