'\ I! a 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 2315 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL A PREANNEXATIONAL ZONE CHANGE TO C-1 -Q FOR APPROXIMATE ACRES OF PROPERTY GENERALLY LOCATED ON THE SOUTHEAST CORNER OF EL CAMINO REAL AND TAMARACK AVENUE. APPLICANT: ROBERTSON CASE NO.: ZC-305 WHEREAS, a verified application for certain propert1 wit: Portions of Lots "E" and "I" of Rancho Aqua Hediondi according to Map thereof No. 823, filed in the Offic the County Recorder, November 16, 1896, has been filed with the City of Carlsbad, and referred to thc Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 27th da] June, 1984, hold a duly noticed public hearing as prescribed to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persc desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannii Commission as follows: A) That the foregoing recitations are true and correct. B) That based on the evidence presented at the public hear the Commission recommends APPROVAL of ZC-305, based on following findings and subject to the following conditil Findings: 1) The proposed project is consistent with the City's Gene Plan since the C-1-Q, General Commercial, zone would im: the C, Community Commercial, designation specified for property by the Land Use Element of the General Plan. \ !! e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I 2) The site is adequate in size and shape to accommodate c permitted in the C-1-Q zone, as discussed in the staff 3) The C-1-Q zone is appropriate for the site for the reas discussed in the staff report. 4) The street system is adequate to accommodate traffic gc by uses permitted in the C-1-Q zone, as discussed in tl: report . 5) The project will not have a significant impact on the environment and, therefore, the Land Use Planning Plana< issued a Negative Declaration on June 12, 1984 and appr the Planning Commission on June 27, 1984. Conditions: ~~~~ ~ ~~~ ~~~~ 1 ) Approval is granted for ZC-305, as shown on Exhibit "X" dated June 27, 1984, incorporated by reference and on 1 the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition the building permits will not be issued for development of subject property unless the City Engineer determines tt facilities are available at the time of application for sewer permits and will continue to be available until t occupancy.
