In addition, the Planning Commission has condition that a note shall be placed on the final that building permits may not be issued for the pro unless the City Engineer determines that sewer serv available, and building cannot occur within the pro unless sewer service remains available, and the Pla Commission is satisfied that the requirements of th public facilities element of the general plan have met insofar as they apply to sewer service for this project. 16 17 18 19 20 21 22 23 24 25 26 b) The Carlsbad School District has written a letter, dated April 6, 1984, stating that school facilities will be available to this project. c) All necessary public improvements have been provide will be required as conditions of approval. d) The applicant has agreed and is required by the inc of an appropriate condition to pay a public facilit fee. Performance of that contract and payment of t will enable this body to find that public facilitie be available concurrent with need as required by tk general plan. e) The applicant will provide park land or pay a park- lieu fee pursuant to the Calavera Hills Master Plar ~ prior to final map approval . f) Assurances have been given that adequate sewer for project will be provided by the City of Carlsbad. 27 4) The proposed project is consistent with the City's Pial Guidelines Manual. 28 Development Ordinance and also complies with the Desigl PC RES0 NO. 2292 -2- I ii w - 1 2 3 4 5 6 7 a 9 10 11 12. 13 14 15 16 17 18 19 20 21 22 23 24 .25. 26 27 28 5) This project'will not cause any significant environmental impacts and a Negative Declaration has been issued by the Lanc Use Planning Manager on May 7, 1984 and approved by the Planning Commission on May 23, 19.84. Conditions: 1 ) Approval is granted for CT 83-32/PUD-62, as shown on Exhibits "A", dated May 9, 1984, "B" and 'ID", dated March .19, 1984, incorporated by reference and on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) This project is approved upon the express condition that the final map shall not be approved unless the City Council finds as of the time of such approval that sewer service is available to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are ava'ilable at the time of application for such sewer permits and will continue to be available until time of occupancy. This'note shall be placed on the final map. 4) This project is 'approved upon the express condition that the applicant shall pay a public facilities fee as required by . City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the applicant for payment of said fee, a copy of that agreement, dated October 20, 1983, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. 5) Prior to final map approval, Village E-2 of the Calavera Hill; Master Plan shall be dedicated to the City for park purposes, pursuant to the provisions of the Calavera Hills Master Plan. If the land dedicated for park purposes is insufficient to meet the needs of this project, the applicant will be required to pay park-in-lieu fees prior to final map approval 6) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable Cit: ' ordinances in effect at time of building permit issuance. 7) . Water shall be provided to this project pursuant to the Water Service Agreement between the City of Carlsbad and the Costa Real Water District, dated May 25, 1983. Land Use Planning Conditions: 8) The applicant shall prepare a reproducible mylar of the final site plan incorporating the conditions contained herein. Saic site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits.
