HomeMy WebLinkAbout1984-09-12; Planning Commission; Resolution 2344P. -3 1 2 3 4 5 6 7 0 0 PLANNING COMMISSION RESOLUTION NO. 2344 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM COUNTY AGRICULTURE ZONE (E-1-A) TO CITY R-1-7500 AND OS ON 85 ACRES OF PROPERTY GENERALLY LOCATED SOUTH OF PALOMAR AIRPORT ROAD AND EAST OF LAUREL TREE LANE APPLICANT: CARLSBAD LAND INVESTORS CASE NO: ZC-278 WHEREAS, a verified application for certain propert1 8 bit: 9 10 11 12 All that portion of land as delineated on survey mas 5715 filed in the Office of County Recorder of San I County, December 19, 1960, being a portion of lot "( the Rancho Agua Hedionda in the County of San Diego, State of California, according to map thereof No. 8; filed in the Office of County Recorder of San Diego County, November 16, 1896, 13 Planning Commission; and 14 has been filed with the City of Carlsbad, and referred to thc provided by Title 21 of the Carlsbad Municipal Code; and 16 WHEREAS, said application constitutes a request as 15 17 WHEREAS, the Planning Commission did on the 12th da] 18 ~y law to consider said request; and 19 Geptember, 1984, hold a duly noticed public hearing as prescl 20 WHEREAS, at said public hearing, upon hearing and 21 desiring to be heard, said Commission considered all factors 22 considering all testimony and arguments, if any, of all persc A) That the above recitations are true and correct. 26 Cornmission as follows: 25 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil 24 relating to the Zone Change; and 23 27 ) That based on the evidence presented at the public heari Commission recommends APPROVAL of ZC-278, based on the following findings and subject to the following conditio 28: 3 /I 0 0 1 1) The proposed change of zone to R-1-7500 and open space 2 Findings: consistent with the general plan designation of RLM, 3 Residential Low-Medium (0-4 du/ac). 4 2) The uses allowed in the R-1-7500 and OS zones are compa with the surrounding properties since development in th Slopes and open space zoning will separate the R-1 acre 5 is designated for resiential uses of similar densities. 6 3) The zoning designations are sensitive to noise impacts 7 from industrial uses to the north and east. Palomar Airport and Palomar Airport Road in restricting 8 residential development to the southern portion of the g 4) The project is consistent with all City public facility icies and ordinances since: 10 11 12 13 14 15 16 17 18 19 20 21 22 23 5) a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will not be approved unless the City Coun finds that sewer service is available to serve the project. In addition, the Planning Commission has condition that a note shall be placed on the final that building permits may not be issued for the prc unless the City Engineer determines that sewer serv available, and building cannot occur within the prc unless sewer service remains available, and the P~E Commission is satisfied that the requirements of tl: public facilities element of the general plan have met insofar as they apply to sewer service for this project. b) The applicant has agreed and is required by the inc of an appropriate condition to pay a public facilit fee. Performance of that contract and payment of t will enable this body to find that public facilitic be available concurrent with need as required by tf general plan.
