'C' ~ %- 1 2 3 4 5 6 @ a PLANNING COMMISSION RESOLUTION NO. 2350 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE APARTMENT PROJECT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF THE FUTURE CORINTIA STREET APPROXIMATELY 500 FEET WEST OF MELROSE AVENUE. APPLICANT : THE MEADOWS CASE NO: SDP 84-8 DEVELOPMENT PLAN NO. 84-8, FOR A 104 UNIT 7 WHEREAS, a verified application has been filed wit 8 City of Carlsbad and referred to the Planning Commission; an 9 WHEREAS, said verified application constitutes a re 10 as provided by Title 21 of the Carlsbad Municipal Code; and 11 WHEREAS, pursuant to the provisions of the Municipa 12 consider said request on property described as: 13 the Planning Commission did, on the 12th day of September, 1 14 15 16 17 18 19 20 21 22 23 24 25 26 27 Parcel 2 of Parcel Map No. 10179 filed June 27, 1980; WHEREAS, at said hearing, upon hearing and consider testimony and arguments, if any, of all persons desiring to heard, said Commission considered all factors relating to Si Development Plan No. 84-8. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni Commission of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public hear the Commission APPROVES SDP 84-8, based on the followir findings and subject to the following conditions: Findings: 1) The project is consistent with the City's General Plan the site has been designated for residential developmer the Land Use Element of the General Plan. In addition, the Planning Commission has a1 condition that a note shall be placed on the final m8 that building permits may not be issued for the projl unless the City Engineer determines that sewer servi available, and building cannot occur within the proj, unless sewer service remains available, and the Plan Commission is satisfied that the requirements of the public facilities element of the general plan have b met insofar as they apply to sewer service for this project. b) The San Marcos School District has written a letter, dated May 25, 1984, stating that school facilities will be available to this project. c) All necessary public improvements have been provided will be required as conditions of approval. d) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. Performance of that contract and payment of th will enable this body to find that public facilities be available concurrent with need as required by the general plan. The proposed project is compatible with the surrounding land uses since surrounding properties are designated fo residential development on the general plan.
