HomeMy WebLinkAbout1984-09-26; Planning Commission; Resolution 2354.- _. k 1 e c 1 PLANNING COMMISSION RESOLUTION NO. 2354 2 3 4 5 6 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM L-C, LIMITED CONTROL, TO 0-S, OPEN SPACE, ON PROPERTY GENERALLY LOCATED ON THE CITY OWNED PORTION OF THE FUTURE MACARIO CANYON PARK, APPLICANT: CITY OF CARLSBAD CASE NO: ZC-314 ~ - WHEREAS, a verified application for certain propert! 7 8 9 Map No. 823 filed November 16, 1896, wit: A portion of Lot "F" of rancho Agua Hedionda accord: 10 Planning Commission; and 11 has been filed with the City of Carlsbad, and referred to thc 12 WHEREAS, said application constitutes a request as 13 by law to consider said request; and 16 September, 1984, hold a duly noticed public hearing as prescl 15 WHEREAS, the Planning Commission did on the 26th da! 14 provided by Title 21 of the Carlsbad Municipal Code; and 17 WHEREAS, at said public hearing, upon hearing and 18 relating to the Zone Change; and 20 desiring to be heard, said Commission considered all factors 19 considering all testimony and arguments, if any, of all persc 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannil 22 A) That the above recitations are true and correct. 23 Commission as follows: 24 25 26 27 B) That based on the evidence presented at the public heari, Commission recommends APPROVAL of ZC-314, based on the following findings and subject to the following conditio Findings: 1 ) The proposed zone change to 0-S, Open Space is consisten the general plan designation of OS, Open Space. 28 x. .- 0 i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 2) The uses allowed within the 0-S zone are compatible with surrounding properties since this zoning will allow the subject property to be developed in accordance with a previously approved park plan which was designed to be compatible with surrounding land uses. 3) This project will not cause any significant environment impacts and a Negative Declaration has been issued by t Use Planning Manager on August 30, 1984 and approved by Planning Commission on September 26, 1984. Conditions: 1 ) Approval is granted for ZC-314, as shown on Exhibit "C" September 6, 1984, incorporated by reference and on fil the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions.
