HomeMy WebLinkAbout1984-09-26; Planning Commission; Resolution 2358- \ e c 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 2358 A RESOLUTION OF THE PLANNING COPD'IISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A TENTATIVE SUBDIVISION MAP AND CONDOMINIUM PERMIT FOR 12 UNITS ON .65 ACRES ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF OLIVE AVENUE BETWEEN THE AT&SF RAILROAD AND GARFIELD APPLICANT : BEARMAN CASE NO: CT 84-13/CP-282 STREET 8 /I WHEREAS, a verified application for certain propert wit: 9 Lot 6 of Block "V" of Palisades Unit No. 2, accordi: 10 Map thereof No. 1803, filed in the office of the Co 11 I/ Recorder August 25, 1924, lpas been filed with the City of Carlsbad, and referred to th 12 13 /I Planning Commission; and 14 I1 WHEREAS, said verified application constitutes a re llas provided by Title 21 of the Carlsbad Municipal Code; and 15 16 I1 WHEREAS, the Planning Commission did, on the 26th d 17 /Iseptember, 1984, hold a duly noticed public hearing as presc by law, to consider said request: and 18 19 20 WHEREAS, at said public hearing, upon hearing and iconsidering all testimony and arguments, if any, of all pers 21 22 desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit: i 23 ll NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni: Commission as follows: (A) That the above recitations are true and correct. 24 25 26 (B) That based on the evidence presented at the public hear the Commission DENIES CT-84-13/CP-282, based on the fol findings : 27 I/// I/// 28 m CI I( a e 1 2 3 4 5 6 7 8 Findings: 1) The project is not consistent with the City's general p since the proposed density of 18.4 du's/acre is towards high end of the 10-20 du's/acre range specified for the by the land use element of the general plan and cannot justified for the following reasons: a) The project does not contain sufficient on-site me over and above that required by the Planned Develop Ordinance. b) The project is not compatible with the existing surrounding development in the vicinity. 9 c) The existing street system (cul-de-sac) is not adeq to handle the traffic that would be generated by th 10 11 project. PASSED, APPROVED AND ADOPTED at a regular meeting o 12 13 Planning Commission of the City of Carlsbad, California, he1 the 26th day of September, 1984, by the following vote, to w 14 15 AYES : Chairman Rombotis, Commissioners Farrow, Schlehuber, McFadden, Smith and L' Heureux 16 17 NOES : None.
