APPLICANT: BANK0 CONDOS CASE. NO : CT 84-27/CP-295 I WHEREAS, a verified application for certain propert. wit: Lot 239 of La Costa Valley Unit No. 5 according to 1 thereof 5730 filed September 8, 1970, I 9 10 has been filed with the City of Carlsbad, and referred to thc Planning Commission; and XI. II WHEREAS, said verified application constitutes a re( ~ ~~ 12//as provided by Title 21 of the Carlsbad Municipal Code; and 13 11 WHEREAS, the Planning Commission did, on the 10th d( 14/(October, 1984 and on the 28th-day of November, 1984, hold a l 15 16 17 noticed public hearing as prescribed by law, to consider sail request; and WHEREAS, at said public hearing, upon hearing and 181!considering all testimony and arguments, if any, of all persi 19 I desiring to be heard, said Commission considered all factors relating to the Tentative Tract Map and Condominium Permit; , NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planni 20 21 22 23 24 Commission as follows: (A) That the foregoing recitations are true and correct. Development shall occur substantially as shown unless otherwise noted in these conditions. 11 A If - 2) This project is approved upon the express condition tha final map shall not be approved unless the City Council as of the time of such approval that sewer service is available to serve the subdivision. 3) This project is approved upon the express condition tha building permits will not be issued for development of subject property unless the City Engineer determines th sewer facilities are available at the time of applicati such sewer permits and will continue to be available un time of occupancy. The study shall be of content, detail an scope to the satisfaction of the City Engineer. As a minimum, the study shall address the following items: a. Site history b. Existing soil condition c. Number, depth, and location of subsurface investiga d. Number, type, and applicability f laboratory tests e. Calculations (e.g.! surficial and rotational failur f. Suitability of design parameters for soils stabilit (e.g., saturation depth) g. Construction design parameters (e.g., allowable bea pressures, increases for depth, lateral bearing pre - passive and active, coefficients of sliding, etc. h. Construction methods and specifications i. Slope maintenance methods, including specific recommendations for suitable vegetation j. Remedial soil construction (e.g., buttress, soil additives, construction fabric, sub-surface drainag benching, etc.) k. Soil construction parameters (e.g., relative compac unsuitable materials removal, moisture adjustment, 24 25 26 27 28 29) Prior to approval of a building permit for the pool, th developer shall submit an engineering geologist's repor justifying the design of the pool and assuring slope stability if the pool membrane is ruptured. 30) The developer shall comply with all the rules, regulati design requirements of the respective sewer and water E regarding services to the project. The structural section of private streets shall conform to City of Carlsbad Standl based on R-value tests. All private streets and drainat systems shall be inspected by the city, and the standarc improvement plan check and inspection fees shall be pail to approval of the final map for this project. 32) All private streets and drainage systems shall be maint, by the homeowner Is association in perpetuity. This res, sibility shall be clearly stated in the CC&R's. 33) All private driveways shall be kept clear of parked veh at all times, and shall have posted "NO Parking/Fire La Away Zone" pursuant to Section 17.04.040, Carlsbad Muni Code. 34) All plans, specifications, and supporting documents for improvements of this project shall be signed and sealed Engineer in responsible charge of the work. Each sheet be signed and sealed, except that bound documents may bm signed and sealed on their first page. Additionally th skeet of each set of plans shall have the following certificate: "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for thi project, that I have exercised responsible charge over design of the project as defined in Section 6703 of the Business and Professions Code, and that the design is consistent with current standards. I understand that the check of project drawings and specifications by the City of Carlsbad is confined to a only and does not relieve me, as Engineer of Work, of m responsibilities for project design. The tentative map shall reflect the condit: approval by the City. The map copy shall be submitted i City Engineer prior to improvement plan submittal. 36) Approval of this tentative tract map shall expire twent: months from the date of City Council approval unless a : map is recorded. An extension may be requested by the applicant. Said extension shall be approved or denied discretion of the City Council. In approving an extens the City Council may impose new conditions and may revi: existing conditions.
