PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM R-l-10,000 TO RD-M-Q AND OS ON PROPERTY GENERALLY LOCATED BETWEEN CARLSBAD BOULEVARD AND THE AT&SF RAILROAD AT ANACAPA ROAD APPLICANT: 'SO CAL DEVELOPMENT CASE NO: ZC-308 WHEREAS, a verified application for certain property, to qit: Portions of Lots 1 and 2 in Fractional Section 20, Township 12 South, Range 4 West, San Bernardino Meridian, in the City of Carlsbad, in the County of San Diego, State of California,, las been filed with the City of Carlsbad, and referred to the ?lanning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 26th day of September, 1984, and again on the 12th day of December, 1984 hold a luly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons lesiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning :ommission as follows: 4) That the above recitations are true and correct. 3) That .based on the evidence presented at the public hearing, the Commission recommends APPROVAL of ZC-308, based on the following findings and subject to the following conditions: I/// q - 'i 0 0 1 2 Findings: 1) RD-M-U and OS zones are compatible with the General Pla 3 designation of RMH. 4 5 2) 7 6 8 9 3) 4) RD-M-Q and OS zones will assure sensitive and compatibl development on the buildable portions of the property c RD-M-Q and OS zones are suitable for this site since us permitted in these zones are compatible with surroundin existing and future land uses as stated in the staff re Also, the OS zone will protect existing floodplain and wetland areas on the property. The site is adequate in size and shape to accommodate u permitted in the RD-M-Q and OS zones. 10 5) This project will not cause any significant environment the Planning Commission on December 12, 1984. impacts and a Negative Declaration has been issued by t 11 12 Land Use Planning Manager on July 31, 1984 and approved !I Conditions 13 1) 14 15 16 17 18 19 20 21 2) Approval is granted for ZC-308, as shown on Exhibit "X" September 12, 1984, incorporated by reference and on fi the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. This project is approved upon the express condition tha applicant shall pay a public facilities fee as required City Council Policy No. 17, dated April 2, 1982, on fil the City Clerk and incorporated herein by reference, anc according to the agreement executed by the applicant fo: payment of said fee, a copy of that agreement, dated Del 28, 1983, is on file with the City Clerk and incorporatl herein by reference.
