HomeMy WebLinkAbout1984-12-12; Planning Commission; Resolution 23941 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 It! 19 2c 21 22 2z 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 2394 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A PREANNEXATIONAL ZONE CHANGE FROM A-70 (COUNTY) TO R-1-8000 and R-1-7500 ON PROPERTY GENERALLY LOCATED SOUTH OF THE SOUTHERLY EXTENSION OF PONTIAC DRIVE. APPLICANT: FALCON HILLS CASE NO.: ZC-318 WHEREAS, a verified application for certain property, to wit: That portion of Lot J of Ranch0 Agua Hedionda according Map No. 823 filed November 16, 1896, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 12th day of December, 1984, hold a duly noticed public hearing as prescribed law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change: and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the above mentioned recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission recommends APPROVAL of X-318, based on the following findings and subject to the following conditions: Findings: 1) The proposed zone change to R-1-8000 and R-1-7500 is consistent with the General Plan designation of RLM, Residential Low-Medium (O-4 du/ac). ///I tc 'I - 0 0 1 2 4 3 compatible with the surrounding properties since these icies and ordinances since: 2) The uses allowed in the R-1-8000 and the R-1-7500 zone properties are also zoned R-1-8000 and R-1-7500. 3) The project is consistent with all City public facility 5 6 7 8 9 10 11 a) The Planning Commission has, by inclusion of an apF condition to this project, insured that the final n not be approved unless the City Council finds that service is available to serve the project. In addi the Planning Commission has added a condition that shall be placed on the final map that building pern not be issued for the project unless the City Engir determines that sewer service is available, and bui cannot occur within the project unless sewer servic remains available, and the Planning Commission is : that the requirements of the public facilities eler the general plan have been met insofar as they appl sewer service for this project. 12 13 14 15 16 17 4) This project will not cause any significant environmenl impacts and a Negative Declaration has been issued by 1 Use Planning Manager on November 19, 1984 and approved Planning Commission on December 12, 1984. Conditions: 1 ) Approval is granted for ZC-318, as shown on Exhibit "X' November 20, 1984, incorporated by reference and on fi: Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 18 2) This project is approved upon the express condition thi Council Policy No. 17, dated April 2, 1982, on file wi' to the agreement executed by the applicant for payment July 24, 1984, is on file with the City Clerk and inco application will not be consistent with the General P1 19 22 fee, a copy of that agreement, dated December 13, 1984 21 City Clerk and incorporated herein by reference, and a1 20 applicant shall pay a public facilities fee as requirec herein by reference.
