APPLICANT: CARLSBAD GATEWAY CENTER CASE NO: . SDP 84-5 WHEREAS, a verified application has been filed with City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a req as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal the Planning Commission did on the 14th day of November, 1984 the 23rd day of January, 1985 and on the 14th day of February 1985, consider said request on property desc.ribed as: A portion of Parcels 1 and 2, in the City of Carlsba County of San Diego, State of California as shown at 10060 of Parcel Maps filed in the Office of the Coun Recorder of San Diego County, May 23, 1980.; WHEREAS, at said hearing, upon hearing and consideri testimony and arguments, if any, of all persons desiring to L ~heard, said Commission considered all factors relating to Sit Development Plan No. 84-5. ~ NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin Commission of the City of Carlsbad as follows: (A) That the foregoing recitations are true and correct. (B) That based on the evidence presented at the public heari the Commission APPROVES SDP 84-5, based on the following findings and subject to the following conditions: //// //// I I I L. d- l/ e 0 1 Findings: The project is consistent with all City public facility 2/! In addition, the Planning Commission has i condition that a note shall be placed on the final n that building permits may not be issued for the proj unless the City Engineer determines that sewer servi available, and building cannot occur within the proj unless sewer service remains available, and the Plar Commission is satisfied that the requirements of the public facilities element of the general plan have k met insofar as they apply to sewer service for this project. b) All necessary public improvements have been providec' will be required as conditions of approval. c) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. Performance of that contract and payment of tt will enable this body to find that public facilities be availahle concurrent with need as required by the general plan. 15 area. 16 2) The project is consistent with M-Q zone standards and is compatible with surrounding existing and future uses in 17 18 19 20 21 22 23 24 25 26 27 28 3) The project, as conditioned, is consistent with the "El Camino Real Corridor Standards". 4) The uses as listed on Exhibit "Xvr, dated October 10, 198 are compatible with existing and future permitted uses i this vicinity as stated in the staff report. 5) This project will not cause any significant environmenta impacts and a Negative Declaration has been issued by th Use Planning Manager on September 18, 1984 and approved Planning Commission on January 23, 1985. 6) The project is located within the Palomar Airport Influe area and has been found to be consistent with the provis of the Palomar Airport Comprehensive Land Use Plan per t letter from SANDAG dated, August 27, 1984. Conditions: 1 ) Approval is granted for SDP 84-5, as shown on Exhibit "A dated August 24, 1984 and "B" - "G", dated July 24, 1984 incorporated by reference and on file in the Land Use P1 Office. In addition, this plan shall incorporat landscape standards identified for this area in the Land Guidelines Manual. 9) A 500' scale map of the project shall be submitted to th Land Use Planning Manager prior to the recordation of th final map. Said map shall show all lots and streets wit and adjacent to the project. 10) All parking lot trees shall be a minimum of 15 gallons i size. The developer shall provide erosion control measures and shall construct temporary desiltation/dete basins of type, size and location as approved by the Cii Engineer. The basins and erosion control measures shal' shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer pr the start of any other grading operations. The access easement shal no less than 24 feet wide and shall include access from Palmer Way and El Camino Real via .the right in/out drive permitted by this project. Improvements listed in this section shall be installed c agreed to be installed by secured agreement by the devel before the issuance of any building permit. The develoF shall obtain approval of the plans from the City Enginee pay all associated fees and performance guarantees prior issuance of any building permit. The developer shall in said improvements to the satisfaction of the City Engine prior to issuance of a Certificate of Occupancy or OCCUF of any portion of the project for any purpose.
