I1 PLANNING COMMISSION RESOLUTION NO. 2428 2 3 4 5 6 7 8 9 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A 70 UNIT TENTATIVE MAP AND PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF ALGA ROAD AND MELROSE DR.IVE. APPLICANT: MEADOWCREST CASE NO: CT 85-8/PUD-82 WHEREAS, a verified application for certain propertq wit: Lot 1 of Carlsbad Tract No. 79-25(B) Unit No. 1 accc to Map No. 10243 filed October 20, 1981., 10 Planning C,ommission; and 11 has been filed with the City of Carlsbad, and referred to thc 12 WHEREAS, said verified application constitutes a re< 13 considering all testimony and arguments, if any, of all persc 18 WHEREAS, at said public hearing, upon hearing and 17 law to consider said request; and 16 April, 1985, hold a duly noticed public hearing as prescribed 15 WHEREAS, the Planning Commission did, on the 10th da 14 as provided by Title 21 of the Carlsbad Municipal Code; and relating to the Tentative Tract Map and Planned Unit Developn 20 desiring to be heard, said Commission considered all factors 19 21 A) That the above recitations are true and correct. 23 Commission as follows: 22 NOW, THEREFORE, 3E IT HEREBY RESOLVED by the Plannir 24 25 26 27 B) That based on the evidence presented at the public heari the Commission hereby recommends APPROVAL of CT 85-8/PUD based on the following findings and subject to the follo conditions: //// //// 28 I1 0 0 1 Findings: /I 2 4 3 1) 5 6 2) 7 3) a 9 10 11 12 13 14 15 16 17 The project is consistent with the City's general plan s the proposed density of 6.6 du's/acre is within the dens range of 4-10 du's/acre specified for the site as indica the land use element of the general plan. The site is physically suitable for the type and density the development since the site is adequate in size and s to accommodate residential development at the density pr posed . The project is consistent with all City public facility icies and ordinances since: a) The Planning Commission has, by inclusion of an appropriate condition to this project, insured that final map will .not be approved unless the City Counc finds that sewer service is available to serve the project. In addition, the Planning Commission has a condition that a note shall be placed on the final m that building permits may not be issued for the proj unless the City Engineer determines that sewer servi available, and building cannot occur within the proj unless sewer service remains available, and the Plan Commission is satisfied that the requirements of the public facilities element of the general plan have bc met insofar as they apply to sewer service for this project. b) The San Marcos School District has written a letter, April 4, 1985, stating that school facilities will bl available to this project. 18 19 2o I 18 19 2o I 21 22 23 24 25 c) Park-in-lieu fees are required as a condition of ap- proval . d) All necessary public improvements have been provided will be required as conditions of approval. e) The applicant has agreed and is required by the incl of an appropriate condition to pay a public faciliti fee. The developer shall comply all conditions and requirements the City Engineer may im with regards to the hauling operation. The developer shall exercise special care during the construction phase of this project to prevent any off-si siltation. The developer shall provide erosion control measures and shall construct temporary desiltation/deten basins of type, size and location as approved by the Cit Engineer. The basins and erosion control measures shall shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer pri the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the a' served shall be protected by additional drainage facilit slope erosion control measures and other methods require1 approved by the City Engineer. The developer shall main. the temporary basins and erosion control measures for a of time satisfactory to the City Engineer and shall guar. their maintenance and satisfactory performance through c< deposit and bonding in amounts and types suitable to the Engineer. Additional drainage easements and drainage structures sh provided or installed as may be required by the County Department of Sanitation and Flood Control or the City E: neer. The developer shall pay the current local drainage area prior to approval of the final map for this project or si construct drainage systems in conformance with the Mastel Drainage Plan and City of Carlsbad Standards as required the City Engineer. Each sheet be signed and sealed, except that bound documents may be signed and sealed on their first page. Additionally the sheet of each set of plans shall have the following certificate: "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for this project, that I have exercised responsible charge over t design of the project as defined in Section 6703 of the Business and Professions Code, and that the design is consistent with current standards.
