HomeMy WebLinkAbout1985-04-10; Planning Commission; Resolution 2430'- /I 0 0 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 2430 A RE;SOLUTION OF THE PLANNING COMMISSION OF THE CITY CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PE TO ALLOW CONSTRUCTION OF A BRANCH FIRE STATION ON PE GENERALLY LOCATED ON THE SOUTHWEST CORNER OF BUTTERC ROAD AND BATIQUITOS LANE. APPLICANT: CITY OF CARLSBAD CASE NO.: CUP-268 6 7 8 9 WHEREAS, a verified application has been filed with City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a req as provided by Title 21 of the Carlsbad Municipal Code; and 10 I/ WHEREAS, pursuant to the provisions of the Municipal 11 // the Planning Commission did, on the 10th day of April, 1985, 12 13 duly noticed public hearing to consider said application on property described as: 14 15 That portion of real property in the City of Carlsba County of San Diego, State of Ca.lifornia, as dedicat, document F.P. 73-237096 of Official Records. 16 ll WHEREAS, at said public hearing, upon hearing and 3.7 18 19 considering all testimony and arguments, if any, of all perso desiring to be heard, said Commission considered all factors relating to CUP-268. 20 I1 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannini 21 22 Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. 23 24 B) That based on the evidence presented at the public hearil the Commission APPROVES CUP-268, based on the following findings and subject to the following conditions: 25 26 27 28 Findings: 1) The proposed use is necessary and desirable for the development of the community, is essentially in harmony 1 the various elements and objectives of the General Plan, is not detrimental to existing uses or to uses specifica: permitted in this zone for the reasons stated in the sta: report . I 0 0 1 2 2) The subject property is adequate in size and shape to accommodate the proposed use for the reasons stated in t staff report. 3 4 5 6 7 3) All of the yards, setbacks, walls, fences, landscaping a other features necessary to adjust the requested use to existing and permitted future uses in the neighborhood w provided and maintained for the reasons stated in the st report. 4) The street system serving the subject property is adegua properly handle all traffic generated by the proposed us1 the reasons stated in the staff report. 8 5) This project will not cause any significant environmenta impacts and a Negative Declaration has been issued by th' 9 Use Planning Manager on March 18, 1985 and approved by t' Planning Commission on April 10, 1985. 10 11 12 13 14 6) Additional fire services are needed to adequately serve and businesses in the southwest quadrant of the City. 7) The activity is compatible with the goal and objectives Public Safety Element and the development guidelines of General Plan. 8) The activity will be located near the intersection of tw major thoroughfares, Poinsettia Lane and Paseo del Norte I-5 11 Conditions: II l6 I ) Approval is granted for CUP-268, as shown on Exhibits "A 17 "C", dated March 19, 1985, incorporated by reference and file in the Land Use Planning Office. Development shall 18 substantially as shown unless otherwise noted in these conditions. This conditional use permit shall be reviewed by Land Use Planning Manager on a yearly basis to determine conditions of this permit have been met and that the use not have a significant detrimental impact on surround- ing properties or the public health and welfare. If the Use Planning Kanager determines that the use has such significant adverse impacts, the manager shall recommend the Planning Commission, after providing the permittee t opportunity to be heard, add additional conditions to mi the significant adverse impacts. This permit may be rev any time after a public hearing, if it is found that the has a significant detrimental affect on surrounding land and the public's health and welfare, or the conditions i. herein have not been met. This permit may be extended fl reasonable period of time not to exceed five years upon application of the permittee made not less than 90 days to the expiration date. In granting such extension, the Planning Commission shall find that no substantial adver affect on surrounding land uses or the public's health a welfare will result because of the continuation of the permitted use. If a substantial adverse affect on surro land uses or the public's health and welfare is found, t extension shall be considered as an original application conditional use permit. There is no limit to the number extensions the Planning Commission may grant. 21 9) Building identification and/or addresses shall be pla.ced new and existing buildings so as to be plainly visible f 22 street or access road; color of identification and/or ad shall contrast to their background color. 23 IIEngineering: 24 25 26 27 10) This project is approved upon the express condition that building permits will not be issued for development of t! subject property unless the City Engineer determines tha. capacity is available at the time of application for sucl permits and will continue to be available until time of occupancy. 28 PC RES0 NO. 2430 -3- I/ 0 e 1 11) 2 12) 3 4 5 6 7 8 9 10 11 12 l3 16) 14 15 16 l7 17) 18 19 20 21 22 23 24 25 26 27 13) 14) 15) The developer shall obtain a gradinq permit prior to the cornmencement of any clearing or grading of the site, The grading for this project is defined as "controlled gl by Section 11,06,17O(a) of the Carlsbad Municipal Code, Grading shall be performed under the observation of a cil engineer whose responsibility it shall be to coordinate : inspection and testing to insure compliance of the work I the approved grading plan, submit required reports to tht Engineer and verify compliance with Chapter 11.06 of the Carlsbad Nunicipal Code. A separate grading plan shall be submitted and approved < separate grading permit issued for the borrow or disposal if located within the city limits, All slopes within this project shall be no steeper than 2 Prior to hauling dirt or construction materials to any PI construction site within this project the developer shall submit to and receive approval from the City Engineer fo~ proposed haul route, The developer shall comply with all conditions and requirements the City Engineer may impose regards to the hauling operation. The drainage system shall be designed to ensure that runc resulting fron. a 10-year frequency storm of 6 hours or 24 duration under developed conditions, is equal to or less the runoff from a storm. of the same frequency and duratic under existing developed conditions. Both 6 hour and 24 storm durations shall be analyzed to determine the detent basin capacities necessary to accomplish the desired resu Improvements listed in this section shall be installed or agreed to be installed by secured agreement by the develo before the issuance of any building permit. The develope shall obtain approval of the plans from the City Engineer pay all associated fees and perform-ance guarantees prior issuance of any building permit, The developer shall ins said improvements to the satisfaction of the City Enginee prior to issuance of a Certificate of Occupancy or occupad any portion of the project for any purpose. The improveml are : a) Street widening, curb, gutter, sidewalk, wheel chair from existing improvements on Poinsettia Lane, along Batiquitos Lane and along Buttercup Road to join the existing curb line to the west. b) Completion of dra-inage improvements in the detention per CT 81-30 including installation of adequate enerq dissipating rip-rap to prevent further erosion along 1 toe of fill slopes. c) Street lights, d) Street trees, 28 PC RES0 NO, 2430 -4- I *- I/ 0 0 1 2 3 4 5 6 7 18) 19) The developer shall comply with all the rules, regulatio design requirements of the respective sewer and water ag regarding services to the project. The design of all private streets and drainage systems s approved by the City Engineer prior to issuance of any g or building permit for this project. The structural sec all private streets shall conform to City of Carlsbad St based on R-value tests. All private streets and drainag systems shall be inspected by the city, and the standard improvement plan check and inspection fees shall be paid to issuance of any building or grading permit for this project. 8 20) A11 plans, specifications, and supporting documents for improvements of this project shall be signed and sealed 9 Engineer in responsible charge of the work. Each sheet be signed and sealed, except that bound documents may be 10 and sealed on their first page.
