APPLICANT: SANTA FE KNOLLS CASE NO.: CT 85-5 CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL FOR A 73 6 // WHEREAS , a verified application for certain property 7 11 wit: 8 9 Lot 140 of Record Map 9959 recorded in the Office of County Recorder of San Diego County, State of Califc on December 31, '1 980, as File 80-440244, I 10 I/has been filed with the City of Carlsbad, and referred to the 11 12 Planning Commission; and WHEREAS, said verified application constitutes a req 13 ll as provided by Title 21 of the Carlsbad Municipal Code; and 14 /I WHEREAS, the Planning Commission did, on the 24th da 15 16 April, 1985, hold a duly noticed public hearing as prescribed law to consider said request; and l7 I/ WHEREAS, at said public hearing, upon hearing and 18 ll considering all testimony and arguments, if any, of all perso 19 ~ 'desiring to be heard, said Commission considered all factors 20 21 22 23 24 25 26 27 28 relating to the Tentative Tract Map. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Plannin! Commission as follows: A) That the above recitations are true and correct. €3) That based on the evidence presented at the public hearil the Commission recommends APPROVAL of CT 85-5, based on following findings and subject to the following conditio] Findings: 1) The project is consistent with the City's general plan s: the proposed density of 3.09 du's/acre is within the den: range of 0-4 du's/acre specified for the site as indicatc the land use element of the general plan. 0 0 1 2) This project is part of the original Santa Fe Knolls (C! 9(B)) project, which has an overall density of 3.0 du/ac 2 thereby being within the mean density of 3.0 cu/ac estal for the RLM General Plan designation by City Council Po: 3 7872. 4 3) The site is physically suitable for the type and densit; development since the site is adequate in size and shapc 5 accommodate residential development at the density prop 6 4) The project is consistent with all City public facility icies and ordinances since: 7 a 9 10 11 12 13 a) The Planning Commission has, by inclusion of an app condition to this project, insured that the final m not be approved unless the City Council finds that . service is available to serve the project. Conditions : 1 ) Approval is granted for CT 85-5, as shown on Exhibit "A April 4, 1985, incorporated by reference and on file in Land use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions, 2) This project is approved upon the express condition thal final map shall not be approved unless the City Council as of the time of such approval that sewer service is aT to serve the subdivision. 3) This project is approved upon the express condition that building permits will not be issued for development of t subject property unless the City Engineer determines the facilities are available at the time of application for sewer permits and will continue to be available until ti occupancy. Sail facilities shall at a minimum include a bench, free fro! advertising, and a pole for the bus stop sign. The ben pole shall be designed in a manner so as to not detract the basic architectural theme of the project and said d shall be subject to the approval of the Land Use Planni Manager and North County Transit District. 20) The developer shall display a current Zoning and Land U in the sales office at all times, and/or suitable alter to the satisfaction of the Land Use Planning Manager. 21) All sales maps that are distributed or made available t public shall include but not be limited to trails, futu existing schools, parks, and streets 22) Building identification and/or addresses shall be placet new and existing buildings so as to be plainly visible street or access road; color of identification and/or ac shall contrast to their background color. 23) All buildable lots and future buildings shall comply wi. standards of the R-1-7500 zone. 24) Existing on site trees located within the identified ri: woodland area shall be maintained where possible. The applicant shall be required to construct snow fencing a that portion of the riparian woodland area which is out the graded portion of the property, identified on tenta map CT 85-5, prior to the issuance of a grading permit subject to the approval of the Land use Planning Manage each oak or sycamore tree within the riparian area and the graded portion of the property which wwill be elimi through project development, the applicant will be requ replace with three specimen trees of comparable species applicant shall prepare a revegetation plan, subject to approval of the Land Use Planning Manager, in order to implement this mitigation measure. Prior to any gradin! applicant shall agree to fully implement this condition not to destroy any mature oak or sycamore tree outside 1 graded portion of the property during grading operation: to carelessness of machine operator or otherwise. This agreement shall contain a liquidated damages clause reql the applicant to pay the sum of $2500.00 for each tree destroyed to the Carlsbad Parks and Recreation Departrnei The agreement shall be secured subject to the approval t Land Use Planning Manager. The applicant shall be requ construct a permanent fence around the identified ripar woodland area as part of the project. If any such condition determined to be invalid this approval shall be invalid the City Council determines that the project without the condition complies with all requirements of law. 5 26) Prior to the approval of any building permits for this PI 6 product elevations shall be submitted for review by the I 7 8 9 commencement of any clearing or grading of the site. The developer shall provide erosion control measures and shall construct temporary desiltation/detel basins of type, size and location as approved by the Cil Engineer. The basins and erosion control measures shal: shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer pri the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the ? served shall be protected by additional drainage facilit slope erosion control measures and other methods require approved by the City Engineer. The developer shall mair the temporary basins and erosion control measures for a of time satisfactory to the City Engineer and shall guar their maintenance and satisfactory performance through c deposit and bonding in amounts and types suitable to the Engineer. Additional drainage easements and drainage structures SI- provided or installed as may be required by the County Department of Sanitation and Flood Control or the City E neer. The developer shall pay the current local drainage area prior to approval of the final map for this project or s construct drainage systems in conformance with the Maste Drainage Plan and City of Carlsbad Standards as required City Engineer. The owner of the subject property shall execute a hold h agreement regarding drainage across the adjacent propert to approval of the final map for this project. The drainage system shall be designed to ensure that runt resulting from a 10-year frequency storm of 6 hours or 2, duration under developed conditions, is equal to or less the runoff from a storm of the same frequency and duratil under existing developed conditions. Both 6 hour and 24 storm durations shall be analyzed to determine the deten basin capacities necessary to accomplish the desired res unless prior facilities presenting meet this condition. The developer shall make an offer of dedication to the C all public streets and easements required by these condi or shown on the Tentative Map. The offer shall be made Certificate on the Final Map for this project. All land offered shall be granted to the City free and clear of a: liens and encumbrances and without cost to the City.
