PLANNING COMMISSION RESOLUTION NO. 2453 2 3 4 5 6 7 A lU3SOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING AN 8 UNIT APARTMENT PROJECT ON PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF UNICORN10 STREET NEAR ALGA ROAD AND EL FUERTE STREET. I b) School fees will be paid to ensure the availability of school facilities in the San Marcos school district. c) All necessary public improvements have been provided or I will be required as conditions of approval. d) The applicant has agreed and is required by the inclusion of an appropriate condition to pay a public facilities fee. Performance of that contract and payment of the fee will enable this body to find that public facilities will be available concurrent with need as required by the General Plan. 4) The proposed project is compatible with the surrounding future land uses since surrounding properties are designated for residential development on the General Plan. 5) This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land Use Planning Manager on May 2, 1985, and approved by the Planning Commission on June 26, 1985. I :," 1;nditions : 18 Approval is granted for PCD-78, as shown on Exhibits "A" - "H", dated May 23, 1985, incorporated by reference and on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these 19 conditions. I 20 2) 21 22 23 24 25 26 27 28 3) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that sewer facilities are available at the time of application for such sewer permits and will continue to be available until time of occupancy. This project is approved upon the express condition that the applicant shall pay a public facilities fee as required by City Council Policy No. 17, dated April 2, 1982, on file with the City Clerk and incorporated herein by reference, and according to the agreement executed by the a2plicant for payment of said fee, a copy of that agreement, dated November 16, 1984, is on file with the City Clerk and incorporated herein by reference. If said fee is not paid as promised, this application will not be consistent with the General Plan and approval for this project shall be void. PC RES0 NO. 2453 -2- a 0 1 4) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable City 2 ordinances in effect at time of building permit issuance. 3 5) This approval shall become null and void if building permits are not issued for this project within one year from the date 4 of project approval. 5 6 6) Water shall be provided by the San Marcos Municipal Water 7 District. Land Use Planning Conditions: 7) 8 9 10 11 12 13 8) The applicant shall prepare a detailed landscape and irriga- tion plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of building permits. Such landscape plan shall conform with the street tree theme along Alga Road as established in the City's Landscape Guidelines Manual. The plan also shall specify that a minimum of 30 percent of the trees will be specimen size of between 24-48 inch boxes. These trees shall be shown ~ on the final landscape plan. All parking lot trees shall be a minimum of 15 gallons in size. I ~ All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 15 l4Il9) 10) Any signs proposed for this development shall be designed in 16 conformance with the City's Sign Ordinance and shall require review and approval of the Land Use Planning Manager prior to 17 installation of such signs. 18 19 20 21 22 23 24 25 26 27 28 11) Trash receptacle areas shall be enclosed by a six-foot high masonry wall with gates pursuant to City standards. Location of said receptacles shall be approved by the Land use Planning 1 Manager. 12) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets, pursuant to Building Department Policy No. 80-6, to the satisfaction of the Land Use Planning Manager and Building and Planning Director. 13) Prior to the issuance of building permits, a plan shall be submitted and approved by the Land Use Planning Manager showing the improvements which will occur in the fitness center. Such plan shall specify the types and manufacturer's names of the equipment which will be installed. The equipment shall be in place in the fitness center before certificates of occupancy are issued and shall not be modified without approval by the Land Use Planning Manager. 1PC RES0 NO. 2453 -3- ~ I 0 0 1 2 3 14) Bomanite paving strips five feet in width shall extend across the parking lot from the two landscaped medians (next to parking spaces No. 6 and No. 15) to visually break up the asphalt. This paving shall be in place prior to the occupancy of any units. I 4 5 6 7 I 15) A six-foot high cedar fence, with masonry pillars placed every 20 feet shall be constructed along both lengths of the 215 , foot property lines, (except for that portion of the fence situated within the frontyard setback which shall be 42 inches in height) and along Alga Road. Such fence shall be double- faced and view-obscuring. This fence shall be constructed prior to occupancy of any units. ~ :I 16) A five-foot high wrought iron fence shall be constructed around the spa. This fence shall be constructed prior to occupancy of any units. 10 I Engineering Conditions 17) The developer shall obtain a grading permit prior to the 11 12 comrnencement of any clearing or grading of the site. The developer shall provide erosion control measures and shall construct temporary desiltation/detention basins of type, size and location as approved by the City Engineer. The basins and erosion control measures shall be shown and specified on the grading plan and shall be constructed to the satisfaction of the City Engineer prior to the start of any other grading operations. Prior to the removal of any basins or facilities so constructed the area served shall be protected by additional drainage facilities, slope erosion control measures and other methods required or approved by the City Engineer. The developer shall maintain the temporary basins and erosion control measures for a period of time satisfactory to the City Engineer and shall guarantee their maintenance and satisfactory performance through cash deposit and bonding in amounts and types suitable to the City Engineer. 10 11 24) 12 13 15 14 17 16 18 19 25) 26) /I 2o 21 27) 22 23 25 24 27 26 Additional drainage easements and drainage structures shall be provided or installed as may be required by the County Department of Sanitation and Flood Control or the City Engi- neer e The developer shall pay the current local drainage area fee prior to issuance of any grading or building permit for this project or shall construct drainage systems in conformance with the Master Drainage Plan and City of Carlsbad Standards as required by the City Engineer. The drainage system shall be designed to ensure that runoff resulting from a 10-year frequency storm of 6 hours or 24 hours duration under developed conditions, is equal to or less than the runoff from a storm of the same frequency and duration under existing developed conditions. Both 6 hour and 24 hour storm durations shall be analyzed to determine the detention basin capacities necessary to accomplish the desired results. Improvements listed in this section shall be installed or agreed to be installed by secured agreement by the developer before the issuance of any building permit. The developer shall obtain approval of the plans from the City Engineer and pay all associated fees and performance guarantees prior to issuance of any building permit. The developer shall install said improvements to the satisfaction of the City Engineer prior to issuance of a Certificate of Occupancy or occupancy of any portion of the project for any purpose. The improvements are: a) Street lights on Unicornio Street. b) Public facilities fronting the project that are damaged c) Sidewalks along Alga Road to the satisfaction of the City or otherwise unacceptable. ~ 28 /I Engineer. Each sheet shall be signed and sealed, except that bound documents may be signed and sealed on their first page. Additionally the first sheet of each set of plans shall have the following certificate: "DECLARATION OF RESPONSIBLE CHARGE" I hereby declare that I am the Engineer of Work for this project, that I have exercised responsible charge over the design of the project as defined in Section 6703 of the Business and Professions Code, and that the design is consistent with current standards. I understand that the check of project drawings and specifications by the City of Carlsbad is confined to a review only and does not relieve me, as Engineer of Work, of my responsibilities for project design. NO. # 18 19 20 21 31) The developer shall provide the City with a reproducible mylar copy of the site plan as approved by the Planning Commission. The site plan shall reflect the conditions of approval by the City. The plan copy shall be submitted to the City Engineer prior to improvement plan submittal and shall be 24" x 36" in size and of a quality and material satisfactory to the City Engineer. 22 32) Prior to approval of any grading or building permits for this plan into the existing City of Carlsbad Street Lighting and 24 annexation of the area shown within the boundaries of the site 23 project, the owner shall give written consent to the Landscaping District No. 1. 25 33) The developer shall provide catch basins onsite at suitable 26 elevations to convey site drainage to curb outlets. Site drainage shall not be conveyed over the driveway approach. 27 34) The developer shall provide a 24-foot wide backup area 28 adjacent to all parking stalls. The 22-foot wide area indicated on the site plan is specifically not approved. The stairs shown on the site plan are specifically not approved. When a grading permit is applied for, such stairs shall not be shown on a submitted plan.
