' T..* a e I. /I PLANNING COMMISSION RESOLUTION NO. 2426 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF SP-12 ESTABLISHING PERMITTED USES AND DEVELOPMENT STANDARr PROPERTY GENERALLY LOCATED .3 MILES SOUTH OF PALOMAF AIRPORT ROAD JUST EAST OF FUTURE COLLEGE BOULEVARD. APPLICANT: CARLSBAD LAND INVESTORS CASE NO: SP-195 6 wit: 7 WHEREAS, a verified application for certain propert1 8 9 10 11 12 13 Portions of land described as description No, 5 as 5 and delineated on Record of Survey Map No. 5715, fil the Off ice of the County Recorder of San Diego Count December 19, 1960, being a portion of Lot G of the I Aqua Hedionda in the County of San Diego, State of California, according to Map thereof No. 823, filed the Off ice of the County Recorder of San Diego Count November 16, 1896, /Ihas been filed with the City of Carlsbad, and referred to thr li Planning Commission; and 14 15 II WHEREAS, said verified application constitutes a reg1 provided by Title 21 of the Carlsbad Municipal Code; and 16 17 WHEREAS, the Planning Commission did, on the 14th da] IiAugust, 1985, hold a duly noticed public hearing as prescribe 18 19 illaw, to consider said request; and 20 21 22 23 24 25 26 27 28 WHEREAS, at said public hearing, upon hearing and cox ing all testimony and arguments, if any, of all persons desi] be heard, said Commission considered all factors relating to Specific Plan; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Cor sion as follows: (A) That the above recitations are true and correct. (B) That based on the evidence presented at the public hearil Commission recommends APPROVAL of SP-195, based on the following findings: //// .* . *" e 0 1 Findings: II 2 3 4 5 6 1) The proposed Specific Plan is consistent with the Gener Plan since it implements the RLM (Low-Medium) land use designation specified for the site by the Land Use Elemc the General Plan. 2) The site is physically suitable in size and shape to accommodate existing uses and those permitted by the spa plan, as discussed in the staff report. 3) The Specific Plan will help mitigate impacts on this prc 7 from Palomar Airport as discussed in the staff report. 8 9 4) Proposed uses would not be detrimental to adjoining use: circulation system, as discussed in the staff report. 5) The specific plan is consistent with the Carlsbad Generz 10 11 and with Sections 65451 and 65452 of the Government Codc regulate the use of specific plans. 5) This project will not cause a significant environmental 12 impact as any applicable mitigation measures identified EIR 83-8 and certified by the City Council on June 4, 15 13 have been incorporated into the project. 14 Conditions: I( 15 16 1) Approval is granted for SP-195, as shown on Exhibit "X", August 14, 1985, incorporated by reference and on file : Land Use Planning Office.
