A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA RECOMMENDING APPROVAL
OF A ZONE CHANGE FROM MULTIPLE FAMILY RESIDENTIAL
TO OPEN SPACE ON 2,244 SQUARE FEET OF PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF OCEAN STREET
APPROXIMATELY 200 FEET SOUTH OF THE ELM
AVENUE/OCEAN STREET INTERSECTION.
APPLICANT: CARLSBAD INN BEACH CLUB

A portion of unnumbered Block in the town of Carlsbad, in
the City of Carlsbad, County of San Diego, State of
California, according to the Map thereof Number 535,
filed in the Off ice of the County Recorder of San Diego
County; and that portion of Ocean Street as shown on said map, closed to public use,

has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
15 /I WHEREAS, said application constitutes a request as
((provided by Title 21 of the Carlsbad Municipal Code; and 16 -~
WHEREAS, the Planning Commission did on the 14th day of 17
August, 1985, hold a duly noticed public hearing as prescribed by
law to consider said request; and

20 I1 WHEREAS, at said public hearing, upon hearing and 11 considering all testimony and arguments, if any, Of all Persons 21

27 Commission recommends APPROVAL ZC-327, based on the following
desiring to be heard, said Commission considered all factors
relating to the Zone Change; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, the
findings and subject to the following conditions: 28

Findings:
1) The proposed Open Space zone which is generally regarded as
less intense than the existing residential zone would be compatible with surrounding residential uses.
2) Since the proposed Open Space zone is regarded as the lowest intensity use relative to all other potential zone possibilities, it is concluded that it would be consistent
with the existing RH, Residential High General Plan
designation.
3) This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land
Use Planning Manager on July 18, 1985 and approved by the
Planning Commission on August 14, 1985.
