HomeMy WebLinkAbout1985-09-25; Planning Commission; Resolution 2493a 0 e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 I 20 21 22 23 24 25 26 27 28 PLANNING COMMISSION RESOLUTION NO. 2493 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A SITE DEVELOPMENT PLAN NO. 85-10, TO EXPAND THE CITY LIBRARY PARKING LOT ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF ELM AVENUE ADJACENT TO THE CITY OF CARLSBAD LIBRARY. APPLICANT: CITY OF CARLSBAD CASE NO.: SDP 85-10 I I WHEREAS, a verified application has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission on the 25th day of September, 1985, considered said request on property described as: Parcel 1, in the City of Carlsbad, County of San Diego, State of California, as shown at Page 9739 of Parcel Maps, filed in the Office of the County Recorder of San Diego County, February 28, 1980. WHEREAS, at said hearing, upon hearing and considering all testimony and arguments, if any, of all persans desiring to be heard, said Commission considered all factors relating to Site Development Plan No. 85-10. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the hearing, the Commission APPROVES SDP 85-10, based on the following findings and subject to the following conditions: Findings: 1) The project is consistent with the City's General Plan since the proposed use is permitted under the Residential- Professional (Qualified) zone for the site as indicated on the Land Use Element of the General Plan. //// II I * a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2) The site is physically suitable for the type and density of th development since the site is adequate in size and shape to accommodate a parking lot as allowed under the proposed zone. 3) The project is consistent with all City public facility pol- icies and ordinances since: a) All necessary public improvements have been provided or will be required as conditions of approval. 4) The proposed project is consistent with the City's Planned Development Ordinance and also complies with the Design Guidelines Manual. 5) This project will not cause any significant environmental impacts and a Negative Declaration has been issued by the Land Use Planning Manager on September 14, 1985 and approved by the Planning Commission on September 25, 1985. 6) This project requires the construction of the improvements or facilities listed in the conditions of approval or the payment of fees in lieu of construction. This project creates a direc need for the improvements or facilities for the reasons stated in the staff report. If the improvements or facilities are nc provided the project will create an unmitigated burden on existing improvements and facilities. Further, the improvements and facilities are necessary to provide safe, adequate and appropriate service to future residents of the project consistent with City goals, policies and plans. Conditions: 1 ) Approval is granted for SDP 85-10, as shown on Exhibits "A" - "C" , dated September 18, 1985, incorporated by reference aa on file in the Land Use Planning Office. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) Approval of this request shall not excuse compliance with all sections of the Zoning Ordinance and all other applicable CitJ ordinances in effect at time of building permit issuance. 3) The applicant shall prepare a 24" x 36" reproducible mylar of the final site plan incorporating the conditions contained herein. Said site plan shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of gradin! permits. 4) The applicant shall prepare a detailed landscape and irrigatic plan which shall be submitted to and approved by the Land Use Planning Manager prior to the issuance of grading permits. //// (2 1- * I >': 1i ? 3 3 .- 28 PC RES0 NO. 2493 -2- a 0 5) All parking lot trees shall be a minimum of 15 gallons in 1 size. 2 6) All landscaped areas shall be maintained in a healthy and thriving condition, free from weeds, trash, and debris. 3 4 to approval of Zone Change 336. 7) Approval of Site Development Plan No. 85-10 is granted subject 5 6 8) 7 8 9 10 11 12 9) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposec. by this approval or imposed by law on this project are challenged this approval shall be suspended as provided in Government Code Section 65913.5. If any such condition is determined to be invalid this approval shall be invalid unless the City Council determines that the project without the condition complies with all requirements of law. In accordance with Chapter 21.18.060, Section (3) of the Carlsbad Zoning Ordinance, a solid masonry wall of six feet in heiyht is required along the north and east property lines, where the lot adjoins residentially designated properties. This wall shall be installed prior to residential development occurring on the parcel to the north. 13 14 10) The lighting for the parking area shall be designed so that Engineering: 17' Manager. 16 11) The sidewalk adjacent to Elm Avenue shall be completed to the 15 properties. there is no light spillover onto adjacent residential satisfaction of the City Engineer and Land Use Planning 18 19 20 21 22 23 12) The developer shall obtain a grading permit prior to the commencement of any clearing or grading of the site. 13) The grading for this project is defined as "controlled grading by Section 11.06.170(a) of the Carlsbad Municipal Code. Grading shall be performed under the observation of a civil engineer whose responsibility it shall be to coordinate site inspection and testing to ensure compliance of the work with the approved grading plan, submit required reports to the City Engineer and verify compliance with Chapter 11.06 of the Carlsbad Municipal Code. The developer shall provide erosion control measures of type, size and location as approved by the City Engineer. ~ 19) The slopes created by this development shall be heavily landscaped immediately following grading activity. 20) The drainage from this development shall not drain out the I driveway, the applicant shall utilize an inlet/outlet system to carry stormldrainage. This shall be shown on the final grading plan. ~ 21) The westerly portion of the proposed driveway shall be reconstructed to match the radius type entrance as shown on DWC 258-8, Sheet 2. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 25th day of September, 1985, by the following vote, to wit: AYES : Chairman Schlehuber, Commissioners: L'Heureux, Marcus, McFadden, Smith and Holmes. NOES : None. ABSENT: Commissioner Hall.
