PLANNING COMMISSION RESOLUTION NO. 2497
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING AN AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN FROM RESIDENTIAL LOW MEDIUM (RLM) TO NEIGHBORHOOD COMMERCIAL (N) ON PROPERTY
GENERALLY LOCATED ON THE WEST SIDE OF THE
COUNTRY STORE, AT 4901 EL CAMINO REAL
APPLICANT: THE COUNTRY STORE CASE NO.: GPA/LU 85-3
WHEREAS, a verified application for an amendment to the
General Plan designation for certain property located, as shown on
Exhibit "A", dated October 9, 1985, attached and incorporated
herein, has been filed with the Planning Commission; and
WHEREAS, said verified application constitutes a request
for amendment as provided in Title 21 of the Carlsbad Municipal
Code; and
WHEREAS, the Planning Commission did, on the 9th day of
October, 1985, hold a duly noticed public hearing as prescribed by
law to consider said request;
WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the General Plan Amendment.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad, as follows:
A) That the above recitations are true and correct.
B) That based on the evidence presented at the public hearing, t Commission DENIES GPA/LU 85-3, based on the following findings:

Findings:
1) The proposed amendment does not meet the criteria described in
the Land Use Element of the General Plan for locating
neighborhood commercial development at the intersections of primary and secondary streets and for reasons stated in the staff report.
2) The proposed amendment would increase a strip commercial area
along a primary arterial roadway (El Camino Real) which is
contrary to policies in the Land Use Element of the General
Plan. 1 7 3) The intensification of land use from residential to commercial
would greatly increase traffic generated onto El Camino Real
intersection spacing policies as discussed in the staff
