II PLANNING COMMISSION RESOLUTION NO, 2498 2 3 4 5 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A ZONE CHANGE FROM R-A-IO TO C-2 ON PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF THE COUNTRY STORE, AT 4901 EL CAMINO REAL, APPLICANT: THE COUNTRY STORE CASE NO: ZC-326 - 6 wit: 7 WHEREAS, a verified application for certain property, to 3451., 9 the City of Carlsbad, County of San Diego, State of 8 Portion of Lot "I", Rancho Aqua Hedionda, Parcel 1, in California, according to parcel map thereof No. 10 Planning Commission; and 11 has been filed with the City of Carlsbad, and referred to the 12 WHEREAS, said application constitutes a request as 13 14 provided by Title 21 of the Carlsbad Municipal Code; and relating to the Zone Change; and 20 desiring to be heard, said Commission considered all factors 19 considering all testimony and arguments, if any, of all persons 18 WHEREAS, at said public hearing, upon hearing and 17 law to consider said request; and 16 October, 1985, hold a duly noticed public hearing as prescribed by 15 WHEREAS, the Planning Commission did on the 9th day of 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 22 Plan. 28 1) The proposed zone change is not consistent with the RLM 27 Findings: 26 findings and subject to the following conditions: 25 B) That based on the evidence presented at the public hearing, the 24 A) That the above recitations are true and correct. 23 Commission as follows: Commission DENIES ZC-326, based on the following residential land use established for the site by the General I 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 2) The street system serving the project is not adequate to handle the increased traffic that would be generated by a change in zone. 3) The C-2 zone would intensify a strip commercial situation which is contrary to policies in the Land Use Element of the General Plan. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 9th day of October, 1985, by the following vote, to wit: AYES: Chairman Schlehuber, Commissioners: L’Heureux, Marcus, McFadden, Smith, Holmes and Hall.
