HomeMy WebLinkAbout1985-11-13; Planning Commission; Resolution 2512e 0 1 2 3 4 5 6 7 PLANNING COMMISSION RESOLUTION NO. 2512 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING DENIAL OF A 174 UNIT TENTATIVE TRACT MAP AND PLANNED UNIT DEVELOPMENT ON PROPERTY GENERALLY LOCATED IN VILLAGE L-2 OF THE CALAVERA HILLS MASTER PLAN AREA. APPLICANT: CALAVERA HILLS COMPANY CASE NO: CT 85-4/PUD-79 WHEREAS, a verified application for certain property, to I wit: 8 Portion of Lot "D" of Rancho Agua Hedionda according to 9 Map No. 823 filed November 16, 1896, 10 Planning Commission; and 11 has been filed with the City of Carlsbad, and referred to the 12 WHEREAS, said verified application constitutes a request 13 law to consider said request; and 16 November, 1985, hold a duly noticed public hearing as prescribed by 15 WHEREAS, the Planning Commission did, on the 13th day of 14 as provided by Title 21 of the Carlsbad Municipal Code; and 17 WHEREAS, at said public hearing, upon hearing and 18 desiring to be heard, said Commission considered all factors 19 considering all testimony and arguments, if any, of all persons relating to the Tentative Tract Map and Planned Unit Development. 20 21 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 22 A) That the above recitations are true and correct. 23 Commission as follows: //// 28 //// 27 //// 26 based on the following findings: 25 B) That based on the evidence presented at the public hearing, 24 the Commission hereby recommends DENIAL of CT 85-4/PUD-79, \ 0 e 1 2 Findings: I) The proposed project is not in conformance with the Calavera 3 the master plan area. 4 Hills Master Plan, since the applicant has not entered into an agreement for the orderly provision of public facilities in 5 of the General Plan since areas with slope 40 percent or 6 2) The proposed project is not in conformance with recent City policies adopted as part of the review of the Land Use Element greater and an unimproved San Diego Gas & Electric easements 7 were utilized for density calculations. 8 9 3) The requested density cannot be justified by the design of the project, 4) The applicant is no longer actively processing this 10 PASSED, APPROVED AND ADOPTED at a regular meeting of the 11 application, 12 the 13th day of November, 1985, by the following vote, to 13 Planning Commission of the City of Carlsbad, California, held on wit: 14 15 16 17 AYES: Chairman Schlehuber, Commissioners: L'Heureux, Marcus, McFadden, Smith, Holmes & Hall.
