HomeMy WebLinkAbout1986-01-08; Planning Commission; Resolution 25231. ll m 9 1 2 3 4 5 6 7 8 PLANNING COMMISSION RESOLUTION NO. 2523 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO BUILD TEN CARPORTS IN A SIDEYARD SETBACK GENERALLY LOCATED ON THE NORTH SIDE OF CHINQUAPIN AVENUE BETWEEN GARFIELD STREET AND THE AT&SF RAILROAD. APPLICANT: SEA PINE PARTNERS CASE NO.: V-369 WHEREAS, a verified application for certain property, to wit: The southwesterly 60 feet of Lot 1, Block "S" of Palisades No. 2 according to Map 1803 filed August 25, 1924, 9 10 11 . has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request 12 as provided by Title 21 of the Carlsbad Municipal Code; and 13 I/ WHEREAS, the Planning Commission did on the 8th day of 14 desiring to be heard, said Commission considered all factors 18 considering all testimony and arguments, if any, of all persons 17 16 law to consider said request; and 15 ganuary, 1986, hold a duly noticed public hearing as prescribed by WHEREAS, at said public hearing, upon hearing and 19 llrelating to V-369. I 20 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 21 Commission of the City of Carlsbad as follows: 22 A) That the above recitations are true and correct. 23 24 B) That based on the evidence presented at the public hearing, Findings: 25 26 1) There are exceptional or extraordinary circumstances 27 28 the Commission APPROVES V-369, based on the following findings and subject to the following conditions: applicable to this property that do not apply generally to other property in the same vicinity and zone for the reasons stated in the staff report. I .1) 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2) The subject property is being denied a substantial property right possessed by other property in the same vicinity and zone for the reasons stated in the staff report. 3) The granting of such variance would not be materially detrimental to the public welfare and injurious to other property in the vicinity and such variance will not adversely affect the General Plan for the reasons stated in the staff report. Conditions: 1) Approval is granted for V-369, as shown on Exhibits "Av1 and 11 B I1 , dated December 10, 1985, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions. 2) Approval of this variance does not affect the conditions of approval for PCD-65, previously issued on this project. This variance shall comply with those conditions. 3) Carports shall be adequately lighted to the satisfaction of the Planning Director. Lighting shall not infringe on adjacent properties. PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission of the City of Carlsbad, California, held on the 8th day of January, 1986, by the following vote, to wit: I/ AYES: Chairman Schlehuber, Commissioners McBane, Marcus, Smith, Holmes & Hall.
