PLANNING COMMISSION RESOLUTION NO. 2527
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, DENYING THE
CONSTRUCTION OF A FOUR UNIT APARTMENT BUILDING
ON PROPERTY GENERALLY LOCATED ON THE EAST SIDE
OF GARFIELD STREET BETWEEN CHINQUAPIN AVENUE
AND SEQUOIA AVENUE.
APPLICANT: FITZGERALD-IRVINE
CASE NO: PCD-85
WHEREAS, a verified application for certain property, to
wit:
Lot 10 of Block L of Palisades, City of Carlsbad according
to the map thereof No. 1747 filed in the off ice of the
County Recorder of San Diego County, February 5,
1973,

heard, said Commission considered all factors relating to the 19
all testimony and arguments, if any, of all persons desiring to be 18
WHEREAS, at said hearing, upon hearing and considering 17
January, 1986, consider said request; and 16
WHEREAS, the Planning Commission did on the 8th day of 15
as provided by Title 21 of the Carlsbad Municipal Code; and 14

(A) That the foregoing recitations are true and correct. 23

NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning

(B) That based on the evidence presented at the hearing, the Com- mission DENIES PCD-85, based on the following findings:

Findings:
1) The requested density exceeds the density allowed for this
area under the General Plan.
2) Development standards for the Beach Area Overlay have not been
met. These include:
a) The building exceeds the 25 foot height limit.
b) Structure is not compatible with surrounding development.
c) Required parking has not been provided.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 8th day of January, 1986, by the following vote, to wit:
AYES : Chairman Schlehuber, Commissioners: McBane,
Marcus, Smith, Holmes and Hall.
NOES : None.
ABSENT: Commissioner McFadden.
ABSTAIN: None.
