A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING A
CONDITIONAL USE PERMIT FOR AN ELEMENTARY SCHOOL
ON PROPERTY GENERALLY LOCATED ON VILLAGES M & N
OF THE CALAVERA HILLS MASTER PLAN,

6 WHEREAS, a verified application has been filed with the 1 i
7 City of Carlsbad and referred to the Planning Commission; and 1
8 WHEREAS, said verified application constitutes a request
9 as provided by Title 21 of the Carlsbad Municipal Code; and
10 WHEREAS, pursuant to the provisions of the Municipal Code,
11 the Planning Commission did, on the 8th day of January and the Ii

22nd day of January, 1986, hold a duly noticed public hearing to
consider said application on property as described as:

WHEREAS, at said public hearing, upon hearing and
considering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors l8

~ NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
A) That the foregoing recitations are true and correct.
B) That based on the evidence presented at the public hearing, 23 the Commission APPROVES CUP-280, based on the following
findings and subject to the following conditions: 24
Findings: 25 1) The proposed use is in conformance with the Calavera Hills 26 Master Plan which has designated this site for development as 1 an elementary school. 27

2) That the proposed use is necessary and desirable for the
development of the community, is essentially in harmony with the various elements and objectives of the General Plan and is not detrimental to existing uses specifically permitted in this zone since the site has been designated as an elementary school site in the Calavera Hills Master Plan and City's
General Plan.
3) The subject property is adequate in size and shape to
accommodate the proposed use for the reasons stated in the
staff report.
4) All of the yards, setbacks, walls, fences, landscaping and
other features necessary to adjust the requested use to
existing and permitted future uses in the neighborhood will be
provided and maintained.
5) The street system serving the subject property is adequate to
properly handle all traffic generated by the proposed use.
6) This project will not cause any significant environmental
impacts and a Negative Declaration has been issued by the
Planning Director on December 26, 1985 and approved by the
Planning Commission on January 22, 1986.
Conditions:
1 ) Approval is granted for CUP-280, as shown on Exhibits "Ar1 -
I1 E II I dated December 27, 1985, incorporated by reference
and on file in the Planning Department. Development shall
occur substantially as shown unless otherwise noted in these
conditions.
2) This project is approved upon the express condition that building permits will not be issued for development of the subject property unless the City Engineer determines that
sewer facilities are available at the time of application for
such sewer permits and will continue to be available until time of occupancy.
3) All roof appurtenances, including air conditioners, shall be architecturally integrated and concealed from view and the sound buffered from adjacent properties and streets.
4) If any condition for construction of any public improvements or facilities, or the payment of any fees in lieu thereof, imposed by this approval or imposed by law on this project ar challenged this approval shall be suspended as provided in
Government Code Section 65913.5. If any such condition is
determined to be invalid this approval shall be invalid unles
the City Council determines that the project without the
condition complies with all requirements of law.

A cross walk shall be painted on Tamarack Avenue, and across
the parking/access to this school, Appropriate advance
warning signs, and speed control signs shall also be installed.
The proposed drainage outlets on the north end of this project shall be combined into one system, and shall not produce
erosion velocities at the point of release.
The School District shall obtain a grading permit prior to the
commencement of any clearing or grading of the site.

Fire Conditions:
17) Prior to the construction of the project, complete building
plans shall be subinitted to and approved by the State Fire
Marshall ,
18) Additional public and/or onsite fire hydrants shall be
provided if deemed necessary by the State Fire Marshal,
19) The applicant shall submit two (2) copies of a site plan
showing locations of existing and proposed fire hydrants and
onsite roads and drives to the State Fire Marshal for
approval ,

21) All required fire hydrants, water mains and appurtenances
shall be operational prior to combustible building materials
being located on the project site.
22) Brush clearance shall be maintained according to the
specifications contained in the City of Carlsbad Landscape
Guidelines Manual.
23) All fire alarm systems, fire hydrants, extinguishing systems,
automatic sprinklers, and other systems ,pertinent to the
project shall be submitted to the State Fire Marshall for
approval prior to construction.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
Planning Commission of the City of Carlsbad, California, held on
the 22nd day of January, 1986, by the following vote, to wit:
AYES : Commissioners: Marcus, McFadden, Holmes & Hall.
NOES : Chairman Schlehuber, Commissioners: Smith &
McBane.
ABSENT: None.
