PLANNING COMMISSION RESOLUTION NO. 2540
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, DENYING A SITE DEVELOPMENT PLAN NO.
85-7, TO ALLOW DEVELOPMENT OF A COMMERCIAL CENTER ON
PROPERTY GENERALLY LOCATED ON THE SOUTHWEST CORNER OF LA
COSTA AVENUE AND RANCHO SANTA FE ROAD.
APPLICANT: LEVANTE PROPERTIES
CASE NO: SDP 85-7
WHEREAS, a verified application has been filed with the
City of Carlsbad and referred to the Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Hunicipal Code; and
WHEREAS, pursuant to the provisions of the Municipal Code,
the Planning Commission did, on the 26th day of February, 1986,
consider said request on property described as:
Lot 249 of Map 7457 La Costa Vale Unit No. 1.
WHEREAS, at said hearing, upon hearing and considering all
testimony and arguments, if any, of all persons desiring to be
heard, said Commission considered all factors relating to Site
Development Plan No. 85-7.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing,
the Commission DENIES SDP 85-7, based on the following
findings:

1 ) The proposed commercial project is not in conformance with the
RMH (Residential) category of the Land Use Element of the
General Plan.
2) The proposed commercial project is not a permitted use under
the current RDM-Q zoning of the property.

4) The site is too small to accommodate commercial use and is not consistent with General Plan guidelines for this type of use.
4 5) The use as proposed is incompatible with surrounding
5 development because the site is too small to provide adequate setbacks.
6 PASSED, APPROVED AND ADOPTED at a regular meeting of the
7:llanning Commission of the City of Carlsbad, California, held on
8 :he 26th day of February, 1986, by the following vote, to
9 wit:
3) The commercial project as proposed will create traffic
10 AYES: Chairman Schlehuber, Commissioners: McBane, McFadden, Smith, Holmes & Hall.
