A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A VARIANCE TO ALLOW ONE
PARKING SPACE IN THE FRONTYARD SETBACK, AND CONSTRUCT A 6-
FOOT FENCE INSTEAD OF A BLOCK WALL ON PROPERTY LOCATED AT
2774 JEFFERSON STREET.
APPLICANT: FORSYTH
CASE NO: V-37 1
II WHEREAS, a verified application for certain property, to
/Iwit:
Lot 4 of Schell and Sites addition to Carlsbad, in the
City of Carlsbad, County of San Diego, State of California, according to the Map thereof No. 2145, filed in the Office of the County Recorder of San Diego County,
February 20, 1929,
has been filed with the City of Carlsbad, and referred to the
Planning Commission; and
WHEREAS, said verified application constitutes a request
as provided by Title 21 of the Carlsbad Municipal Code; and
WHEREAS, the Planning Commission did on the 26th day of
Narch, 1986, hold a duly noticed public hearing as prescribed by
law to consider said request; and
WHEREAS, at said public hearing, upon hearing and
iconsidering all testimony and arguments, if any, of all persons
desiring to be heard, said Commission considered all factors
relating to the Variance; and
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission as follows:
(A) That the foregoing recitations are true and correct.
(B) That based on the evidence presented at the public hearing, the
Commission APPROVES V-371 , based on the following findings and
conditions:

Findings:
1) There are exceptional or extraordinary circumstances applicable to this property that do not apply generally to
other property in the same vicinity and zone for the reasons
stated in the staff report,
2) The subject property is being denied a substantial property
right possesssed by other property in the same vicinity and
zone for the reasons stated in the staff report,
3) The granting of such variance would not be materially
detrimental to the public welfare and injurious to other
property in the vicinity and such variance will not adversely
affect the General Plan for the reasons stated in the staff report.
4) That the granting of such variance will not adversely affect
the comprehensive General Plan, as discussed in the staff
report.
Conditions:
1) Approval is granted for V-371, as shown on Exhibits "A" and
'IB" of SDP 85-20, dated March 10, 1986, incorporated by
reference and on file in the Planning Department. Development
shall occur substantially as shown unless otherwise noted in
these conditions.
2) All conditions approved for SDP 85-20 shall be incorporated herein by reference. This variance shall run concurrently with SDP 85-20. Should approval for SDP 85-20 expire, then approval for V-371 shall expire at the same time.
