HomeMy WebLinkAbout1986-04-23; Planning Commission; Resolution 2549e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I PLANNING COMMISSION RESOLUTION NO. 2549 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CHANGE FROM RD-M (RESIDENTIAL DENSITY MULTIPLE) TO RD-M-5 (RESIDENTIAL DENSITY MULTIPLE - 5 DU/AC) ON PROPERTY GENERALLY LOCATED AT THE SOUTHEAST CORNER OF ALGA ROAD AND ALICANTE ROAD, APPLICANT: CITY OF CARLSBAD CASE NO: ZC-342 WHEREAS, a verified application for certain property, to wit: Parcels 1 & 3 of Parcel No. 13158 in the City of Carlsbad, County of San Diego, State of California, recorded in the Office of the County Recorder of San Diego County on February 21, 1984 as File No. 84-061796 of Official Records, has been filed with the City of Carlsbad, and referred to the Planning Commission; and WHEREAS, said application constitutes a request as provided by Title 21 of the Carlsbad Municipal Code; and WHEREAS, the Planning Commission did on the 23rd day of April, 1986, hold a duly noticed public hearing as prescribed by law to consider said request; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to the Zone Change; and NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, th Commission recommends APPROVAL of 2C-342, based on the following findings and subject to the following condition: //// I€ 9 0 1 2 3 4 5 6 Findings: 1) The proposed zone change is consistent with the City's General Plan since the Residential Density Multiple-5 zone is consistent with and implements the Residential Medium land use designation proposed for the site, as discussed in the staff report . 2) The proposed zone change is consistent and compatible with surrounding land uses and zoning, as discussed in the staff report. I 7 8 9 impacts and a Negative Declaration has been issued by the Lan 10 Use Planning Manager on November 27, 1985 and recommended for approval by the Planning Commission on January 8, 1986. 3) This rezone to RD-"5, would limit the ultimate development intensity on the property to a maximum of 5 du/ac, and would reduce potential traffic impacts. 4) This action will not cause any significant environmental ''11 Condition: l2 13 1) Approval is granted for GPA/LU 85-13, as shown on Exhibit 14 the 8th day of January, 1986, by the following vote, to wit: l6 Planning Commission of the City of Carlsbad, California, held on l5 "A", dated January 8, 1986, incorporated by reference and on file in the Planning Department.
