PLANNING COMMISSION RESOLUTION NO. 2567
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT TO ALLOW A SECOND FREESTANDING SIGN ON PROPERTY GENERALLY
LOCATED AT 5445 PASEO DEL NORTE IN CARLSBAD CAR COUNTRY. APPLICANT: JIM FINNEY PONTIAC CASE NO.: CUP-293
WHEREAS, a verified application has been filed with
7 the City of Carlsbad and referred to the Planning Commission; and
8 WHEREAS, said verified application constitutes a request
9 as provided by Title 21 of the Carlsbad Municipal Code; and

m - 2) That the requested use is necessary or desirable for the development of the community, is essentially in harmony with
the various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the proposed use is to be
located, since the sign will adequately identify a second automobile dealership on the lot and be compatible with other signs in the area.
3) That the site for the intended use is adequate in size and shape to accommodate the use since the sign will not adversely impact circulation on the site.
4) That all of the yards, setbacks, walls, fences, landscaping,
and other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood will be provided and maintained since the proposed second sign will not intrude into any required setbacks or impact any 1 andscaped areas.

5) That the street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use, since the proposed sign will not generate any traffic.
Conditions:
1) Approval is granted for CUP-293, as shown on Exhibits "A" -
IIC", dated May 20, 1986, incorporated by reference and on file in the Planning Department. Development shall occur substantially as shown unless otherwise noted in these conditions.
2) This approval shall become null and void if building permits are not issued for this project within one year from the date of project approval.
3) Approval of Conditional Use Permit, CUP-293 is granted subject to approval of Planning Commission Determination, PCD-
90.
