HomeMy WebLinkAbout1986-08-27; Planning Commission; Resolution 2591i 0 0 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION N0.2591 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A ZONE CODE AMENDMENT, AMENDING TITLE 21, OF THE CARLSBAD MUNICIPAL CODE, BY ADDING CHAPTER 21.100 CREATING THE TRANSPORTATION CORRIDOR (TC) ZONE. APPLICANT: CITY OF CARLSBAD CASE NO.: ZCA-197 WHEREAS, the Planning Commisson did, on the 13th day of 7 request; and 9 noticed public hearing as prescribed by law to consider said 8 August, 1986 and on the 27th day of August, 1986 hold a duly 10 WHEREAS, at said public hearing, upon hearing and 11 considering all testimony and arguments, if any, of all persons 12 relating to the Zone Code Amendment. 13 desiring to be heard, said Commission considered all factors 2.4 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning 15 A) That the above recitations are true and correct. 16 Commission as follows: 17 18 19 20 21 22 23 24 25 26 27 28 B) That based on the evidence presented at the public hearing, the ~ Commission recommends APPROVAL of ZCA-197, according to Exhibit "X", dated July 29, 1986, attached hereto and made a part hereof, based on the following findings: Findings: 1) Creation of the TC zone will ensure that appropriate land uses occur in the railroad right-of-way, which will not preclude future light-rail transit. 2) The proposed standards in the TC zone will ensure compatibility with and buffering from adjacent properties. 3) This project will not cause any significant adverse impacts on the environment because a Negative Declaration was issued by the Planning Director and approved by the Planning Commission on August 27, 1986. //I/ ///I I/// !I I! i 0 0 1 2 the 27th day of August, 1986, by the following vote, to wit: 3 Planning Commission of the City of Carlsbad, California, held on PASSED, APPROVED AND ADOPTED at a regular meeting of the 4 5 6 7 AYES: Chairman Schlehuber , Commissioners: Marcus, McFadden, Schramm, Holmes & Hall. A 2 3 4 5 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 21, OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF CHAPTER 21.100 ESTABLISHING THE TRANSPORTATION CORRIDOR (TC) ZONE. The City Council of the City of Carlsbad, Calfifornia, does ordain as follows: i5 I/ Section 1: That Title 21 of the Carlsbad Municipal Code 7 8 9 10 11 12 13 94 15 is amended by the addition of Chapter 21.100 to read as follows: Chapter 21.100 I! T-C Transportation Corridor lisections: I 21.100.010 Intent and purpose. 21.100.020 Permitted uses and structures. 21.100.030 Precise development plan. 21.100.040 Uses permitted by conditional use permit. 21.100.050 Conditions. 21.100.060 Minimum lot area. I 16 11 21.100.010 Intent and purpose. The intent and purpose [of the T-C zone is to provide for and ensure the Dreservation of 17 19 (2) Insure compatibility of the development 'transportation modes; 18 certain public transpo;ation rights-of-way which ;ill: (1) other conditions of approval necessitated by the development. 21 (4) Provide for public improvements and environmental factors; 20 (3) Insure that due regard is given to /with the general plan and the surrounding developments; .~ /Insure that adequate land area is available for future : 22 21.100.020 Transporation corridor permitted uses and structures. (3) Agriculture: Only the following agricultural uses, and buildings accessory to such agricultural uses, are permitted in the T-C zone: (A) Field and seed crops, (3) Truck crops, (C) Horticultural crops, (D) Orchards and vineyards, (E) Tree farms, (F) Fallow lands. b (4) Recreational facilities (public), limited to: (A) Passive open space, (B) Bicycle paths, (C) Pedestrian trails. (5) Any other use which the Planning Commission or City Council may determine to be similar to the permitted uses in the zone and to fall within the intent and purposes of the zone; the provisions of Chapter 21.41; (6) Signs, except for billboards, subject to (7) Public Streets 13 ! 21.100.030 Uses and structures permitted by conditional x* e ermit. Subject to the provisions of Chapter 21.50, the owing uses and structures are permitted by conditional use 15 16 permit: ~ 21.100.040 Site Development Plan. The decision-making body may impose such conditions on the site plan as are determined 23 necessary to implement and ensure consistency with the provisions of .this chapter, the General Plan, the local coastal land use 24 plans, and any applicable specific plans, to ensure that the uses are sufficiently isolated from any rail facilities. 25 I 21.100.060 Minimum lot area.
