APPLICANT: HALE CASE NO.: V-377 WHEREAS, a verified application for certain property, to wit: Northeasterly 60 feet of the southwesterly 120 feet of Tract 219 of Thum Lands, in the City of Carlsbad, County of San Diego, State of California, according to Map No, 16181, has been filed with the City of Carlsbad, and referred to the Planning commission; and WHEREAS, said verified application constitutes a request as provided by Title 21 of the Carlsbad Municipal code; and WHEREAS, the Planning Commission did, on the 27th day of August, 1986, hold a duly noticed public hearing as, prescribed by law to consider said request: and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Commission considered all factors relating to V-377. NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That based on the evidence presented at the public hearing, the Commission APPROVES V-377, based on the following findings and subject to the following conditions: Findings: 1) There are exceptional or extraordinary circumstances or condition applicable to the property or to the intended use that do not apply generally to the other property in the same I vicinity and zone for reasons outlined in the staff report, b. * -* 9 0 1 2 3 4 5 6 2) Such variance is necessary for the perservation and enjoyment of a substantial property right possessed by other property in the Same vicinity and zone for reasons outlined in the staff report. 3) The granting of such variance Will not be materially detrimental to the public welfare or injurious to the property in the vicinity and such variance will not adversely affect the comprehensive general plan for reasons outlined in the staff report. 1 ;i onditions: Approval is granted for V-377, as shown on Exhibit "A" , dated August 13, 1986, incorporated by reference and on file in the Planning Department. Development shall occur substantially 9 as shown unless otherwise noted in these conditions. 10 Approval of this variance is contingent upon approval of CUP- 11 291. All conditions contained in Planning Commission Resolution No. 2560 are hereby incorporated into this 12 13 Resolution.
